Received RFE on August 13 2012 regarding our k1.

USCIS requested original copies of Intent to Marry as my fiancee's was a copy, although they asked for both.

Requirement that Petitioner and Beneficiary have met in person:

Circumstances of Meeting- submit information regarding circumstances under which the pet. and bene. met to establish the relationship. (had already sent them this)

Last Personal Meeting- airline ticket stubs/receipts, atm credit card transactions, copy of passport pages that show identification page and admission stamps, military order. Secondary time dated photos. (Did that but obviously not well enough! this time I am better documenting the airline receipts in connection with the purchase of them on a credit card transaction, as well as receipt of the ring.

They also requested Marriage termination for both of us- a legible copy of final divorce signed by judge or magistrate.... proving previous marriages were terminated. Neither of us have been married!!!!!!! She was able to go to the Registar in her town (Rovaniemi Finland) and get a legal document in english saying she hasn't been married and is single which is in the mail at the moment. So far I haven't found anything like that in the U.S. from the government. tried my local court house the city recorders office with no luck, next I will try the county clerk and if that doesn't work I will type a document and get it notarized saying I have never been married accompanied with a tax return form and signed paper from my parents stating I have never been married.

Also I know if a USC is going to get married in another country they need a legal document stating they are single and can be married in which case they obtain it from the US embassy from the country in which they will be getting married. It may be possible to call the Embassy where your fiancee is from and explain the situation and see if they can provide that sort of doument for you.

Hope that helps if anyone else gets a marriage termination request that have never been married.

Daniel, when you filled out I-129F item # 6 for the petitioner and Beneficiary it ask about the marital status, divorced, married, single, etc. if you checked the single box for both beneficiary and petitioner, you do not need to submit proof because if the petitioner is not telling the truth he/she will be in deep trouble due to the background check USCIS conduct on each petition, because the petitioner, could get single certificate from the present state he/she is living in, but that does not mean that their was a marriage in another state, because the petitioner will not get clearance of being single from all the other states of USA, if it could let you feel good you could write a statement under oath that you are single and have not been previously married or being divorced. As regards to the RFE, look for all of my posting I explained that for several VJ members.

We got one because they didn't realize that the UK divorce decree absolute isn't signed. We had to resend and point out the features that make it the final decree registered with the county

We married on Aug 24, 2013 in a small ceremony in MA

We'll be applying for a CR1 / IR1 visa as soon as we are able

Hi everyone.

Thankfully our RFE was for my fiance the US petitioner to provide the evidence that he is the US citizen.

We did send his brith certificate when we turned in the petition so what do we send in now?

The birth certificate again ? First time it was just one paper and I've seen somebody mention long version of it?? :confused:

Should we send the copy of his entire passport? Does it need to be notarized or something?

Ummmm...I'm new to this site. Can somebody please explain to me what an RFE is.

An RFE is a "Request For Evidence". This happens when they want more information or are missing something in the packet, you will then receive an RFE. Not everyone gets one though, we never did. Just go over everything you are going to submit before sending it in and be sure that you have filled everything in and when needed, fill blanks with N/A or None on forms. ;)

Hi everyone

We've got RFE without any request at all and I am so confused now.

USCIS website states that our case is suspended until they receive the response to RFE or the opportunity to submit expires.

However in the mail we got back the origianl of my USC fiance birth certificate that he attached to the petition along with all the passport pages copies. And there is just a short notice - "Enclosed are original documents you submitted with your petition. Your petition is now being reviewed and you'll be notified when the decision is made."

Mail address and name was hand written with red ink on this form.

We've been waiting for NOA2 for 4 months already and instead of clear instructions we got a puzzle.

It looks like we are not supposed to respond. But RFE is dated October 01. What if "opportunity to submit expires"?

Should we send them that notice back or should we just wait for USCIS to make another move?

Or may be RFE is just the only form USCIS can send anything to the applicant?

you better call the USCIS if it sounds weird.
