Just got an RFE the other day. I submitted our paperwork before I knew this website even existed and thus I guess I did some of it wrong. I find it funny that a timeline ( printed out year by year of each post ) on our facebook walls suggests that we do not have enough proof. Facebook is like a track record of everything that we, as humans have done, so long as you update it. I guess that is my fault for thinking too forward.

I have attached hotel receipts, as well as a picture of my password, do you think that is enough? i don't have plane ticket stubs anymore, although I do have an Expedia destination report ( showing i purchased the tickets ). Do you think this is enough primary? I also added in some more photos though just in case they did not have enough.

submit as many proof as you can. I'm processing my visa and just have the facebook message, Skype message, emails and some proof that he support me financially since our engagement for my interview evidence. I hope, I can get the visa by those evidence. *cross fingers*

He visited me once and we engaged that time. We have many pictures of us together and with my family and more than 7000 messages in the facebook. Good luck for you too :)

you have to submit evidence of meeting the beneficiary in person within the two year period preceding the filing of petition, unless there are culture and religion reasons that you both can not meet in person. there are two type of Evidence 1- PRIMARY EVIDENCE; may include airline ticket stubs and receipts, ATM and credit card transactions, ( that indicate, the petitioner's name, month, day, and year), copies of passport pages that show the identification page and admission stamps, hotel receipts, if either the petitioner or the beneficiary has been married before, they should submit proofs that they were free to mary before submitting their petition.or any evidence that will help the USCIS to determine that petitioner has met the beneficiary within the two years. 2: SECONDARY EVIDENCE, may include Film DATED photographs , of the petitioner and beneficiary, e-mail, phone messages records, and any other electronic communication. Just got my hard copy of my RFE. They listed 2 subjects they need more evidence on.

MARRIAGE TERMINATION:: Submit a legible copy of the final divorce decree signed by a judge or magistrate that shows proof of filing, or the death certificate issued by the civil authorities, that terminated the prior marriage(s) between Edward X. XXXXXXXXXXX and any prior spouses.

First of all, he has never been married before and I doubled checked all the boxes for marital status on the forms and they all are marked correctly with either "single" or "never married" and in the sections for previous spouses, we wrote "none". I am really confused why we got this part of the RFE. If anyone has had this happen or have suggestions about it I would appreciated it. Of course I can't call now until monday. lol

#2 was the requirement that we had met in person in the last 2 years. I knew that one was coming so I have bank statements for the 3 visits I made there before filing all ready to go. :)

Live for today because you never know what tomorrow will bring!

What do you mean if pictures were taken by friends or family include in package? Do you mean they asked her questions about the person taking the picture? or you and her had taken pictures on your own and your friends and family had taken pictures of you guys and you guys added them as well... I'm sorry if I'm sound headbonk.gif with my questions. Sometimes reading so many things from different people confuse me and the littlest things I rethink too much.wacko.gif Also what advice you can give us... with telephone records unfortunately I have METRO PCS and they don't keep phone records on long distance calls, so I've been using phone cards and so does he my Fiance (beneficiary) in the UK; they use prepaid phones for the most part. I have the prepaid call he uses to call me and and I've kept a lot of my phone cards, should I explain this in the letter of us meeting and attach the cards for them to see...

Jean passed her interview at 1:45 pm on Friday 4/27/2012. She will be passing along some important information in a couple of days.

She will be arriving in the USA in 19 days.

I am not trying to give anyone advise, just sharing what worked for us. What I am about to write will surprise even the most savvy.

Jean and I fell madly in love last May after meeting on a dating site. I went on a Filipina site because my younger brother had met someone on this site and was going through the K-1 process. They are now married and unbelievably in love here in the USA.

I visited Jean in the Philippines in August of 2011.

Turns out, she is much younger than me. I worried about how counselors would view our age difference, so I went on line to discover what Immigration VISA Counselors are trained to evaluate. Through study I learned age is not factor.

Since that time we have Skyped and communicated almost every day.

Government Employee;

On Fridays ties come off and the blue jeans come on in most agencies of the Government. Everyone is contemplating plans for their weekend. Of all the days of the week, Friday is the least serious. Make no mistake, most Government employees are hard workers and are very detailed. However, everyone begins looking at the clock at 1:00 p.m., waiting for 4:00 roll around and to start their weekend plans.

So Jean scheduled her interview for FRIDAY.

Government employees have a protocol that must be followed. As an example, someone cannot be denied a VISA based on a counselor's bad day or prejudice. In order to deny a VISA they must have reasonable evidence of inconsistencies (normally, most agents for the government are required to produce "a letter of conversation" of any inconsistent findings). They must document the denial evidence. I guess what I am trying to say is that they must follow protocol.

If one is invited to the interview the initial background check is complete.

The counselor is looking for various types of fraud. They are highly trained to pick up on fraud. I prepared most of our documents original and not copies. I also had documents like bank statements notarized.

So before Jean experienced the biggest day of her life, we looked at all documents to ensure there was no appearance of fraud in the eyes of the counselor. We made sure the evidence of our meeting was solid, we kept receipts of all activities while together in the Philippines; when necessary, when we lacked evidence we reconnected with venders to produce receipts. Pictures of our time together turned to be important.

The counselor asked Jean for specific times and dates of when the pictures were taken. If other pictures are taken by family or friends it was important to include them in the package.

Our on-going relationship documents included over 40 pages of telephone calls, Skype conversations, both verbal and written, receipts for flower sent, phone bills and money transfer receipts.

Proof of Support included 3 months of pay check stubs, 3 years of W-2s, last year's Tax Return, and authentic proof of full time employment. All documents were indexed and tabbed with a table of contents for quick retrieval of information.

In closing we did not give the Embassy Counselor any cause to suggest fraud.

Others waiting to be interviewed with my fiancée were amazed and commented on Jean's 3 inch binder stuffed with documents. She passed with a quick 10 minute interview.

We felt assured prior to the interview. It was better to be over prepared than underprepared. The reward was Jean's quick and solid interview.

In fact, we bought the Airline ticket prior to the interview.

Now before you say didn't you send these in :) well I will tell you that of course I did but I guess they either lost it or it wasn't good enough. Hence my post to try to help others.

1) Evidence of meeting- the RFE says that photographs, flight tickets, and receipts are SECONDARY EVIDENCE, the primary would be a copy of my ENTIRE passport showing trips to Canada. Also the photos have to be FILM DATED not just a note written below as to when they were taken. So I copied my entire Passport front to back showing many trips to Canada and sent it.

2) Divorce Decree- I had already sent a copy of the entire decree, so this time I wrote a cover letter and highlighted the date and everything on the decree. I also sent copies of letters from my attorney and a copy of the invoices from where the decree was filed and listed everything in the cover letter.

3) Letters of Intent- so originally we both hand wrote a full one pager saying where we met and that we were going to get married within 90 days of her getting her visa. So this time I went to www.***removed***/visas/kvisa/fiance-letter-of-intent-petitioner.html and got this basic typed letter, modified it with our names, printed, and then signed it in Blue Ink, dated it and hand printed our names as well below.

I printed the receipt number on EVERYTHING and over-nighted it back the next day.

Anyway they accepted it all this time, and we received the NAO2. I've no idea if the original applications were lost or, if they were not good enough.

Ok well I just got off the phone with USCIS and talked to a really nice lady named Christie. She stated that because because the RFE for the divorce decree has already been sent out that it definitely needs responded to(which I already knew). She said since it is impossible for me to provide a document that does not exist, that I need to write a letter explaining why I am unable to provide a divorce decree (since he has never been married) and provide a notarized statement from him stating that he has never been married and legally free to marry and if I wanted to "over do" it just to make sure, have him get a copy of a name check in the marriage and divorces from the court house showing that his name has no records associated with it notarized by the court clerk.

As for the proof of having met in the last 2 years for me, she stated to also write a letter why I do not have boarding passes, passport stamps, hotel receipts, but that I do have phone bills indicating that I was roaming in Canada and my bank statements showing debits in his home town and surrounding area she told me those were good.

She told me the biggest thing is that if you don't have all the evidence YOU THINK you need for a certain topic, by writing a letter explaining, it gives the adjudicator a heads up before they look at what evidence you have and they already realize why you don't have certain items. This helps them by not expecting to see certain items of evidence they normally receive for evidence before they start going through what you sent. She told me that if I sent the pieces of evidence we talked about, we should be "good to go" and there should be "no problem". I know she is not the one adjudicating the petition, but it really made me feel better hearing how to go about sending it in and the tips for having a letter explaining each section and stating why you sent what you did.
