We got a RFE because Patrick sent in only the first page of the Marriage Termination and they needed a copy of all the pages...awesome!!!!

I'm glad they need just that ;)

That was similar to mine. Simple huh and I have been waiting 40 days since they got the response and yet no resolution.

Can ANYONE sympathize? We send in out i129f in late October and then recieved an RFE in March and they recieved our response on March 21. After 60 days, I filed a service request and we were ordered to wait ANOTHER 25 days! Our RFE was because I didn't check one box. ONE BOX. that shouldnt take over 2 months to check. My fiance and I have been together for over 3 years traveling together full time for half of that time. We are a completely legitimate couple in love. It makes me so angry that this process is taking so long for us whereas I have heard of others who have done it for the wrong reasons have their visa within their hand within months. AH! Anybody had a similiar experience???

I feel your pain, really. I'm in the Vermont Service Center and my response would take all of five minutes to review and approve. Have you heard anything yet?

+ Always send in the LONG version of the birth certificate (USC) - not the short one. If you only happen to have the short one, include copies of ALL pages of the passport of the US citizen.

+ Always send in your vaccination supplement and medical copies (if obtained) with your AOS. Some countries (like Germany) don't give you any copies of that, so be sure to get them again from a civil surgeon in the USA. It might cost a few dollars.

Also, I would like to add that even though we had two RFEs (one for the K-1 and the other one for AOS), we never complained because RFEs are not a big issue at all. It took only about 14 months from when we first started this entire process by sending in the K-1 application to the issue of my Greencard..... and all that with two RFEs.

What do you mean "long version" of birth certificate. I've always only had one. Its one a one page birth certificate I was born in the USA. Should I have a different one?

This is where this thread is going to confuse many. Getting an RFE for lack of evidence to prove you have met in the past two years almost always is due to a lack of primary evidence. Supplying more, or many photos (secondary evidence) will usually not overcome the burden of proof.

This has been borne out time and again by USCIS decisions whereby they have found mostly in favor of primary evidence and rejected secondary evidence such as photos when submitted as sole proof.

Primary evidence is documentary in nature: airline boarding passes, passport exit/entry stamps, hotel receipts, atm withdrawals in city of question, utility bills, apartment leases, etc.

Secondary evidence The USCIS defines secondary evidence as any documentation that can be used to supplement primary evidence but in itself cannot stand alone to prove ones assertions.

Photos are secondary; so are letters from relatives, neighbors or acquaintances, bus/train tickets and essentially anything that cannot be used to prove your point with a very high degree of certainty.

To sum up; very good Primary evidence with some secondary evidence = NO RFE

very weak Primary evidence with some, or lots of secondary= Possible RFE

No Primary evidence..........................................................= RFE

No Primary, lots of secondary.............................................= RFE

As my primary evidence I have my passport stamps from both of my passports (I have double citizenship since I was born in the USA to Chilean parents so I have a USA passport and a Chilean passport) I have exit and entrance stamps for the Chilean passport and entry stamps for the USA passport and my airline itineraries. My airline itineraries are emails from my travel agent is that ok? And since my parents own a house in Chile that is where I stayed while I visited my fiance. We either stayed at my house or his apartment. We also have pictures of us with my family and his family as well as alone. Is that enough information to be approved for the first stage? I was going to add letters from my parents and his family at the interview. Do I have enough proof of relationship or do I need to add more?

Yeah just got a letter saying my second RFE is one the way. Maybe i misread something on the first RFE because my eyes were so full of tears. Good luck to you. Hopefully you don't have the same coming your way!

Ouch! I am so tired of waiting for some news. Even though the 60 days were not up, I was allowed to put in a service request and then after the fifteen day wait and no resolution I sent the email to the service center.

What did the supplental RFE entail?

Our layer called today to see if they recived the rfe papers and they just told us that we need extra copy of divorce signed ny the judge !!!!!!!!! my fiance was suposed to come visit me on tuesday but now he can't anymore cuz he needs to go to the court and get that document . I hate them!!!! this is crazy!!!! another month added to our case for what?????? couldn t they told us from the first rfe what they need exactly?

I got an RFE, letter states: Please submit a copy of a court order as evidence of the legal name change that changed the name from one to another. In the original I-129 package I included a copy of marriage certificate. Did they lose it or misplaced it? Should I mail another copy or how do i get a court order evidence?

We had almost the same problem with divorce certificate. i think yoou should call and ask them exactly what they need . If they need a signature from the judge too like in our situation.

they told us they need extra papers only by phone when the layer called to see if the paper for the first rfe is there. i hope you won t get a second rfe :( goodluck

I just wanted to share some info to people reading this. You can get a RFE at anytime in the K-1 process.

That means, NOA1 - NO2 , NOA2 - Interview, Even After a Interview you may still be subject to more Evidence.

Your only safe once VISA is in HAND
