Have you, or have you not met in person in the last two years? If you have not, you will be denied.

A waiver is only effective if you have solid proof that meeting in person is absolutely impossible. It's very rare to say the least.

Folks, if you did not submit evidence (primary and secondary) that you have met in person, sorry to say that your petition will be denied. It does not matter if you have long term relation and a child out of the relation. I'm not aware that DNA is consider by USCIS a primary evidence. In your case the waiver will not even fly, because waiver is submmitted to justify for the hardship, culture etc, in lieu of meeting in person, but you already having child out of your relation. USCIS needs primary and secondly evidences as I explianed previously. I think if your fiancé is from Canada, yes he will not have stamp on his passport, but he might have arrival and departure stamped dates ( I do not not sure about that). Your best way is to collect primary ( ATM, bank statement by his name, letter from his employer stating that he was in USA from-to dates, if he stayed in hotel, hotel receipt) and secondary evidences.

I am in need of some advice. I submitted the I-129F and it was received in CA processing center on Dec 2nd. With that packet, I sent all the required info and for evidence I submitted all the boarding passes and bank statements showing the purchase of the airline tickets. Since my fiance is from Canada, there isn't any stamps made in the passport. Due to my own insecurities, we did not take any pictures of us as a couple together...(I know you are all groaning that I'm an idiot!). We just had a baby together on March 26th so I am desperate to get this processing moving. The letter requests the G-325 for him which was already filled out and I forgot to send and then this evidence that we have met. In the letter, a portion says the petitioner may also submit bank statements showing that a withdrawal purchase was made in Canada. I have never gone to Canada to visit my fiance...he has only come here to visit because I am a single parent to two other children. Is it a requirement that I go there? I call USCIS to speak to someone about the RFE and she told me to just resubmit everything I had already submitted as this was just kind of general practice when there is an RFE requesting other things. This seems like a shady response as I have read other posts where people didn't get asked for evidence that they had met. Obviously we have met since I just gave birth to our son but any advice in how I can further prove that to them would be greatly appreciated!!

I read your posting again, I believe who is reviewing your petition thinks that the petitioner is only the one who should travel to meet his /her beneificiary (fiancé), and it is not correct, if you have a baby together, why you are going through K1 Visa and all of its evidence trouble, get married and apply to bring your husband to USA, it might take more time than K1 approval , but your husband will get to USA by a green card, instead of K1 Visa..and all the steps that you should be doing with your fiancé ( changing status from K1 to conditional then removing the conditional, etc) will be taken care of if your benenficary comes to USA as a husband but not on K1 visa. Think about it and good luck

Reply to the RFE, with the evidence/information that's requested in the notice.

I'm not sure if a waiver is necessary in your case, but it's my understanding that 'mishka1' (previous post) submitted it due to their circumstances. (read below)

Yes, my waiver statement you copied is correct; waiver is required for two cases, 1- If the petitioner had multiple K1 submission in the past (as required by IMBRA) -2 if the Petitioner and benecificary can not meet in person due to culture, custom or hardship restriction.

And by the way today it has been over 20 days since CSC received my response to their RFE, and my case is still under review :whistle::crying: I'm getting worried, if they are going to deny my petition, why they :devil: do not get over with

In our case, The California Service Center got our RFE return package Friday May 4th. We sent what they requested.

I feel likeI'm back at school, waiting for the results of a test! whistling.gif

Today, we received an email and text notification that our RFE response has been received by CSC. I hope it will not take so long for them to adjudicate our case..

Thank you Jen!! I am having problems because we only have the court online records for my fiance (the American) first divorce. I hesitate whether we need to find a certified copy of the whole decision for filing I1129F. Definetely I will get a certicate for the interview. Can somebody comment? Is an RFE the same as a an I-797C/Notice of Action with "rejection notice" in the field labeled "notice type"?

If so, we received one because we sent TOO MUCH money! (01/31/12)

We sent a correction submission with the correct amount and received another I-797/CNotice of Action which said "Receipt" in the "notice type" field. (02/14/12)

Would either of these be considered the NOA-1?

HI everyone, I received my RFE on 22 may but i still didn t receive a hardcopy in the mail..so i don t know what the RFE reason is.. my question is...i s there anyone who waited that long to receive the hardcopy? txs guys im aT california center ..got my NOA1 on 29 december.

Can ANYONE sympathize? We send in out i129f in late October and then recieved an RFE in March and they recieved our response on March 21. After 60 days, I filed a service request and we were ordered to wait ANOTHER 25 days! Our RFE was because I didn't check one box. ONE BOX. that shouldnt take over 2 months to check. My fiance and I have been together for over 3 years traveling together full time for half of that time. We are a completely legitimate couple in love. It makes me so angry that this process is taking so long for us whereas I have heard of others who have done it for the wrong reasons have their visa within their hand within months. AH! Anybody had a similiar experience???
