Hi everyone,

I applied for a K1 in late October and received my noa1 on October 25. On March 17 I received an RFE stating that I had forgotten to check one box on the i129. ??I sent the request back the next day and the service center received it march 21. it is now April 28, and we have yet to receive a decision even though our reason for RFE seemed quite simple to process. Should I be worried it has taken so long? Has anyone else received an RFE for mistakes on the forms? I am just so tired of waiting and frustrated with the whole process!

Jean passed her interview at 1:45 pm on Friday 4/27/2012. She will be passing along some important information in a couple of days.

She will be arriving in the USA in 19 days.

I am not trying to give anyone advise, just sharing what worked for us. What I am about to write will surprise even the most savvy.

Jean and I fell madly in love last May after meeting on a dating site. I went on a Filipina site because my younger brother had met someone on this site and was going through the K-1 process. They are now married and unbelievably in love here in the USA.

I visited Jean in the Philippines in August of 2011.

Turns out, she is much younger than me. I worried about how counselors would view our age difference, so I went on line to discover what Immigration VISA Counselors are trained to evaluate. Through study I learned age is not factor.

Since that time we have Skyped and communicated almost every day.

Government Employee;

On Fridays ties come off and the blue jeans come on in most agencies of the Government. Everyone is contemplating plans for their weekend. Of all the days of the week, Friday is the least serious. Make no mistake, most Government employees are hard workers and are very detailed. However, everyone begins looking at the clock at 1:00 p.m., waiting for 4:00 roll around and to start their weekend plans.

So Jean scheduled her interview for FRIDAY.

Government employees have a protocol that must be followed. As an example, someone cannot be denied a VISA based on a counselor’s bad day or prejudice. In order to deny a VISA they must have reasonable evidence of inconsistencies (normally, most agents for the government are required to produce “a letter of conversation” of any inconsistent findings). They must document the denial evidence. I guess what I am trying to say is that they must follow protocol.

If one is invited to the interview the initial background check is complete.

The counselor is looking for various types of fraud. They are highly trained to pick up on fraud. I prepared most of our documents original and not copies. I also had documents like bank statements notarized.

So before Jean experienced the biggest day of her life, we looked at all documents to ensure there was no appearance of fraud in the eyes of the counselor. We made sure the evidence of our meeting was solid, we kept receipts of all activities while together in the Philippines; when necessary, when we lacked evidence we reconnected with venders to produce receipts. Pictures of our time together turned to be important.

The counselor asked Jean for specific times and dates of when the pictures were taken. If other pictures are taken by family or friends it was important to include them in the package.

Our on-going relationship documents included over 40 pages of telephone calls, Skype conversations, both verbal and written, receipts for flower sent, phone bills and money transfer receipts.

Proof of Support included 3 months of pay check stubs, 3 years of W-2s, last year’s Tax Return, and authentic proof of full time employment. All documents were indexed and tabbed with a table of contents for quick retrieval of information.

In closing we did not give the Embassy Counselor any cause to suggest fraud.

Others waiting to be interviewed with my fiancée were amazed and commented on Jean’s 3 inch binder stuffed with documents. She passed with a quick 10 minute interview.

We felt assured prior to the interview. It was better to be over prepared than underprepared. The reward was Jean’s quick and solid interview.

In fact, we bought the Airline ticket prior to the interview.

Take a peak at your RFE notice - that, or your online status. It says "allow up to 60 days" or something like that, I cannot recall the exact words. If more time passes than indicated on your RFE, then call USCIS and inquire about your case(service request). While it should be a a fairly easy RFE response to process, you can't always count on it taking less time since you're dealing with humans and your response may be with a person who has alot to process.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

I am in need of some advice. I submitted the I-129F and it was received in CA processing center on Dec 2nd. With that packet, I sent all the required info and for evidence I submitted all the boarding passes and bank statements showing the purchase of the airline tickets. Since my fiance is from Canada, there isn't any stamps made in the passport. Due to my own insecurities, we did not take any pictures of us as a couple together...(I know you are all groaning that I'm an idiot!). We just had a baby together on March 26th so I am desperate to get this processing moving. The letter requests the G-325 for him which was already filled out and I forgot to send and then this evidence that we have met. In the letter, a portion says the petitioner may also submit bank statements showing that a withdrawal purchase was made in Canada. I have never gone to Canada to visit my fiance...he has only come here to visit because I am a single parent to two other children. Is it a requirement that I go there? I call USCIS to speak to someone about the RFE and she told me to just resubmit everything I had already submitted as this was just kind of general practice when there is an RFE requesting other things. This seems like a shady response as I have read other posts where people didn't get asked for evidence that they had met. Obviously we have met since I just gave birth to our son but any advice in how I can further prove that to them would be greatly appreciated!!

My timeframe with my fiance´ is very close to yours as we applied in October and received our NOA 1 on October 26 and we also received RFE on the 29th of March... We have not reached the 60 day mark but I already have a Request for Service in the process. You don't have to wait for the 60 day mark to pass. It's been only about 30 days since the RFE but when I called in I told them that the entire case including the RFE timeframe was beyond the 5 month mark projected and the USCIS employee immediately opened a Request for Service for me and provided me with a referral number to check in on it.

My suggestion would be to call them and tell them your case has exceeded the projected 5 month period and that you'd like a Request for Service to be processed. Good luck.

Hello every one who received RFE recently ( March-April), I'm in the same boat like every one, however my frustration is my RFE was for the whole evidence and documents I submitted in November 14, 2011, my I-129F petition was three pounds and 10 ounce, Beside I have waiver for multiple K1 submission that was included within my original submission. I did not believe it when I received the RFE, Is it possible that they lost or stashed three pounds documents!! any employee can lose one page, two, half pound but NOT THREE :wow: that is :bonk: . I did not have any other alternative except mailing on April 19, 2012 AGAIN the THREE POUNDS EVIDENCE AND DOCUMENTS, and my case was updated on April 20. reading what was posted, and the type of RFE that issued for a box that was unchecked, and they have not make a decision yet is putting me in the desperate tunnel and abyss :crying: comparing to what they requested from me. The response to any submitted RFE will state " You should expect to receive a written decision or written update within 60 days of the date we received your response" my understanding is these within 60 days ARE PLUS THE 5 MONTHS PROCESSING THE PETITION STATED BY USCIS. However, I'm writing to explain to the petitioner who was visited by her Canadian fiancé. YOu must provide the following: Here we go:

REQUIREMENT THAT PETITIONER AND BENEFICIARY HAVE MET IN PERSON:

it must be established that petitioner and beneficiary have met in person and/or have been in each other's physical presence AT ANY TIME DURING THE TWO YEARS IMMEDIATELY PRECEDING THE FILLING OF YOUR PETITION (I-129F). You have to submit information regarding the circumstances under which petitioner and beneficiary met to establish relationship.

- YOU have to submit evidence of meeting.

PRIMARY EVIDENCE: May include airline ticket stubs and receipts. ATM and Credit card transaction ( that indicate, the petitioner's name, month, day, and year, any evidence that will help the USCIS to determine that the petitioner has met the beneficiary within the two year.

SECONDARY EVIDENCE: May Include FILM DATED PHOTOGRAPHS OF THE PETITIONER AND THE BENEFICIARY together.

Disc, videos, e-mails, letters, phone bills and greeting cards DOSES NOT constitute evidence of meeting..

However personal meeting requirement May be waived when it is demonstrated that that personal meeting requirement would result in extreme hardship to the petitioner and /or when personal meeting would violate the beneficiary's strict and long established customs, foreign or social practice.. such waiver must be submitted by the petitioner in writing.

Now return back to the frustrating waiting time for a decision after submitting RFE response, I'm :bonk: very frustrated like you guys, when reading on the VJ web site the average decision to I-129F RFE response is between 4-14 days. I think we can not do anything other than wait and HOPE FOR THE BEST. keep me posted you all..

Thank you, it is for some reason comforting knowing that other people are experiencing the same excruciating wait. I just called and the employee told me that I could only file a service request after the 60 day wait. You must have lucked out and gotten through to a very generous person!

Also waiting, here in Vancouver, CANADA.

California Service Center just received our "1.5 lbs" RFE package today. Hopefully it won't be a long wait.

We also received RFE and we already sent the RFE reply.. In our RFE, proof of meeting is requested.. It's okay because my fiance forgot to include passport stamps, itinerary, boarding passes, and ticket in our original package.. He just included some photos of us together (he thought that pictures are okay, we didn't know that it belongs to the secondary evidences...)... Now, he sent everything and we are hoping that we will hear anything from CSC as soon as possible..

Hello every one, well it has been two weeks now since CSC received my response to the RFE ( as I mentioned I mailed the whole original submitted package again, 3 pounds, 10 ounce). AS I mentioned also I submitted a waiver for previous K1, that I withdraw after it was approved and was terminated upon my request by CSC. That old one I got RFE also but the approval took only EIGHT DAYS. This year or at the present time it is taking them long time, either they have NEW ADJUDICATOR EMPLOYEES WHO IS LEARNING THE JOB AND FIRING RFE to every one :rofl: and it ends by lot of RFE responses and they overwhelmed by the NEW PETITIONS AND TO ADJUDICATE the received RFE responses, OR Gods know what the heck is going on at CSC or another service center :wacko: WE ASk the mighty one to give us patient and let us keep or sanity..

Hello CANbirdUSman, we are having approximately the same time line, and the same weight of documents that we mailed as response to the RFE, did you submitted what they were asking for RFE previously, because in my case this is my second 3 pounds document ( the first was in my original I-129F submission, may be they have lots of rats in their buildings/ filing storage that eating the documents, :bonk:

Have you, or have you not met in person in the last two years? If you have not, you will be denied.

A waiver is only effective if you have solid proof that meeting in person is absolutely impossible. It's very rare to say the least.

Reply to the RFE, with the evidence/information that's requested in the notice.

I'm not sure if a waiver is necessary in your case, but it's my understanding that 'mishka1' (previous post) submitted it due to their circumstances. (read below)

In our case, The California Service Center got our RFE return package Friday May 4th. We sent what they requested.

I feel likeI'm back at school, waiting for the results of a test! whistling.gif

(Final Exams come later…lol….rofl.gif)
