I received an RFE today, but the problem is that at some point in the last year or so I seemed to have misplaced my passport. I have lived in Japan for almost 3 years now and my fiance and I have traveled back to America together, but I currently have no passport and can't send any copies of my visas.

Any suggestions for primary evidence for me? I can provide pay slips from work or copies of credit card bills or bank statements, but I have a bad feeling this won't count as primary evidence. Am I completely screwed? :(

I noticed that my passport was gone last week when I got the email from USCIS that they had sent out an RFE, and have searched daily for it but it looks like it really is gone. I can't believe this horrible timing.

Did you save your plane ticket stubs (boarding passes) when you or your fiance went to visit each other? Those can be used as primary evidence. Also you didn't mention what your RFE was for, it could be that the RFE has nothing to do with the need for more primary evidence if you've already submitted some when you applied.

They specifically requested primary evidence that we met in the past 2 years. My fiance has managed to come up with ticket stubs for a flight we took together here, but of course due to the wonderful ways of Japanese airlines they didn't print the year on the boarding pass. I have her boarding pass from when we went to the US together, but not mine. I also have eticket boarding passes for another flight we took together that actually has the year on it.

My last resort is a rental car receipt from the same trip that has both our names.. the thing is I have her passport and we can prove she went to America and came back to Japan. I wonder if all of it would be enough...

I can't say for sure if this is enough. It seems for a low fraud country like Japan that you shouldn't have any problems but everything is left up to to the officer dealing with your petition. I hope it is enough so you two can move on and be together. Getting RFEs are no fun. Good luck.

You should try to submit the following:

Any flight itineraries for any flights that you took together

Any boarding passes that you may have even if they don't state the year, combined with the itinerary it may work

Pictures of both of you taken within the last 2 years in different places

Credit card statements, ATM receipts showing expenses made in Japan

If you are still living in Japan, you should have or be able to obtain a copy of your lease for your apartment or house and a letter of employment stating the dates during which you've worked for your current job.

Definitely include copies of your fiancee's passport stamps showing that she came to the U.S. if they're not over 2 years old.

This should do the trick and if it doesn't, I would check with the Immigration authorities in Japan as they probably keep records of who comes and goes...

Hello everyone...

I received an rfe requesting more primary evidence that we have met within the two years prior to filing the petition.

I have two questions:

Firstly, I am currently filing from abroad and I live in Turkey (same country as my fiance). İf İ submit receipts from here, do they need to be translated? I have tons of receipts from food shopping for us, and other daily life purchases. Also--I guess İ dont really understand how random receipts from the country in question proves anything.

ATM receipts: Thats it? Just plain old cash withdrawl receipts from Turkey? İ have tons, but cant really see how this proves anything. I sent in my turkish residence permit for christsakes and an ATM cash withdrawl receipt is better than that?

We took a trip together back in november to sweden. Unfortunately, We dont have boarding passes (he popped the question on new years 2011 so we had no knowledge about this whole visa process at that time). All we have are his bank statements that says 'cash withdrawn abroad' during the dates that we were in Sweden.

ahhhhhh--this is so annoying. I see him everyday--Im sitting next to him now, lol How can we send convincing documentation of our normal flow of life together?

I got an RFE and I tell you these form letters are a bit confusing. Do they all start out with the comment about "If the petitioner is, My Name, was born in the U.S. and will be submitting a birth certificate as proof of US citizenship, such must be a civilly registered long-form certificate". I'm wondering if they are questioning my birth certificate here. I sent a copy of the only birth certificate you can currently get in my state. You used to get them at the county level, but now the state handles them all.

Intent to Marry:

We sent one from both of us signed and dated. But either they lost them of didn't like them.

Requirement That Petitioner and Beneficiary have met in person:

Under this are multiple parts

- Circumstances of Meeting

- Last Personal Meeting

Does this mean they want a letter of how we originally met?

And more evidence to prove out meeting within the last two years?

Personally it looks like they just copy and pasted from forms. But its not all that clear to me what they want. Is it the bold and capitalized parts? A little help from those who have gone through this could help a lot.

Thanks

our rfe were: my passport pic and my letter of intent to marry. im the beneficiary.

and to think we hired a lawyer for our K1. I think it was a mistake hiring her. now i asked her how we missed this, she just said that rfe we got are not normal protocol. my passport pic and letter of intent were not included in the original filling and so we got rfe! i guess if we follow the guidelines here, we could have had noa2 instead of rfe.

btw our lawyer's name is tanawa lebreton.

we also received the hard copy of RFE today and we need to provide:

1. a letter of intent to marry

2. petitioner & beneficiary have met in person secondary: film dated photograph together.

i just wanna clarify if the evidences we will provide should be proofs that we have met within 2 years? how about our boarding pass. itinerary & hotel receipts when we had a trip to another country last year 2007?

will it help? or we should just pass evidences from year 2009 to 2011? sorry if i have so many questions. TIA
