I received e-mail that a RFE has been sent to me. I have not received the actual document yet. As I try to figure out what I missed, my best thought was I sent copies of my prior divorces. They were not Ceritified copies, or orignals, and did not include the settlement section. I went ,and got them now. Based on any ones experence would that be a good guess for my RFE.

I received e-mail that a RFE has been sent to me. I have not received the actual document yet. As I try to figure out what I missed, my best thought was I sent copies of my prior divorces. They were not Ceritified copies, or orignals, and did not include the settlement section. I went ,and got them now. Based on any ones experence would that be a good guess for my RFE.

I would say that the fact you sent uncertified copies of your divorce decrees would be a strong contender for the RFE. Although this is only guesswork at this point. I can only relate to my own RFE which was for the fact my certified divorce decree didn't show that the divorce was indeed final and settled (Scottish law). After a visit to the courthouse to obtain a signed statement from the Clerk of Court that my divorce was final, the petition was approved by USCIS. USCIS need to know that you are legally entitled to marry your fiance/e and this means a certified decree stating that the divorce is actually finalized and settled.

I got the letter, and it was the divorce decree, did not say it needed to be Certified, but I sent the wrong document, as it was the notice of entry of Judgement, and there was actually the same document, but it says final judgement, and that was the one they needed. Express mailed it today, so I hope it goes through now

I would say you should be good to go now you have forwarded USCIS the decree saying the divorce is final. Fingers crossed for you and good luck :)

We finally got our RFE in the mail.

They've asked us for more primary or secondary evidence that we've met in person in the two years prior to our filing for the NOA1. (That is a bit of a stickler, as I had been planning to send evidence of the two meetings we've had in the meantime, but that isn't valid information. Only the two years prior to December 7, 2005 count.)

I sent copies of the boarding passes and airline tickets and receipts that we used as we flew back and forth, as well as pictures of us together, along with the original packet.

For my RFE, I'm planning to send those boarding passes and tickets (again), the same pictures I sent before, as well as copies of my passport and some receipts from my trip to Saskatoon to see my fiance. Also, I'm asking my family and friends to write quick notes attesting that they met my fiance when he was visiting me. They didn't ask specifically for that kind of information, but it seems like it might be helpful as corroborating evidence.

Can anyone suggest anything else I might send? I stayed with my fiance, and we didn't use much public transportation, so it's not like I've got hotel receipts or train tickets I can send them.

This is what I included and had no problems:

Documentation such as phone bills showing calls of a long duration to each other. Highlight the other person's phone number so they don't have to search the entire list and include a synopsis, for example: Oct: 50 calls to each other of a total duration of so many hours.

Letter saying that we intend to marry, one from each of us. Include lists of events attended and things you did together, have photos and/or letters to back it up - even say see photo #)

Ensure Question 18 is answered in great detail (explanation of metting in person)

Emails announcing to friends and family details of how we met, our engagement announcement and what our plans are, sent from me and from my fiance.

Boarding passes and other travel information such as restaurant bills, ATM withdrawals, photos in front of the other persons residence and the airport or other easily identifiable places and write on the back details so the person does not have to guess what this photo is about. (Example: Photo in front of airport leaving on this date in this city, photo in restaurant in this city, and see copy of receipt)

Letters from family/friends, preferably on their company letterhead saying they met you at.... and include a personal reference if possible (so and so is a great guy, I have known him for x years, I met his fiance at this event)

Cover letter describing evidence.

That may be excellent advice for some situations, but not "always". In our case, we went through the whole process without ever sending in the USC's birth certificate at all (we used the passport to provide proof of citizenship).

Oh no. I sent only the "short form" of my birth certificate. Our state does have a long form option but it takes 6 weeks to obtain. And I didn't send copies of my passport pages.

Is it possible to make an addendum to an I-129F that's waiting for review. I already received NOA1 with case number. I wonder if I can "pre-empt" the RFE by sending my passport copies?

I think as long as you send it in with your A# on each page with a cover letter of explanation (also with the A# listed) they should be able to connect the file with your additional information. Make sure your names are on EACH page you send. Along with the phrase "originals available upon request"

I tried sending something in to append to my file. I did not submit I-131 with my I-485 package. They sent it back rejected and asked for a copy of the NOA or a check to pay for it separately. If you are sending anything in ensure you copy the NOA or wait until you get one. My thoughts were, don't they have that????? :whistle:

Hello Everyone,

Hey thanks for all the help with this stuff. It's a Godsend to have a place to get all this information.

Ok I just realized that when I sent my I-129F pettition last week that I didn't put names, dates and locations

ont the back of the many photos I sent of our meetings. Is this a huge issue? Will I receive a RFE or whatever? Is this the kind of thing that causes delays? Oh and finanaces.... I recently became unemployed after six years. I am confident I'll find work but I am financially retarded and I owe a bit to the IRS and my credit pretty much sucks. I'm used to earning about 60k a year but for now I am reduced to unemployment until I find more work. Can someone reassure me that when it comes to the I-134 I'll be ok? :blink:

As far as your finances go, you list the last 3 income tax returns. They each must be over the poverty level for the # of people in your household after adding your new wife. You only need a copy of the latest one, BUT I put copies of the other 2 as well, there's a check mark for it so I put it in. You find the poverty level on form I-865P: http://www.uscis.gov/files/form/I-864p.pdf

A note about the I-864 (which is the support affidavit you submit with the AOS later) as compared with the I-134. My husband didn't have the last years tax filed. I submitted the previous 3 years with my I-134 (well his, but I did it for him). The 3rd year back was NOT over the poverty level. I don't know how we slipped by with that information BUT when we submitted the same information with the I-864 it did not slip by and I was RFE'd for that and my husband had to file 2008 taxes. They are basically looking that you are over the poverty line and will be stricter on the AOS app than the initial I-129 app. (on the side, it's kind of crazy that I could get approved to come down here and get married and then on the AOS I could be denied due to information they already approved me on!!!! What would I do, get unmarried, unmove myself and unquit my job and go back to Canada?????) When I called to talk about it, they said that he had to be over the poverty line so instead of the 2008 taxes he could have submitted evidence of assets to bring it up higher. But we opted to submit the last 3 years and I submitted all the optional items such as the letter of employment and the paystubs. Just to be safe and not sorry. Good luck!

You never know if the application will RFE or not due to stuff like that (no annotations on the back of the photos). I've heard yes, but some get away without if they seem clear as to what they are and there is lots of other evidence.

I actually talked to an Officer at VSC and she recommended go to Ethiopia within two weeks or they would cancel my Petition. So I bought

a ticket and went. My fiance was thrilled. We took pictures, made copies of the tickets, my Ethio Visa and sent them to VSC. I have had two touches

on the 21st and 22nd of December and nothing since. I don't understand why it would take so long. The letter they sent to me said they would

make a decision within 60 days. That will be Sunday 01/09/10. Do you guys have any ideas?

Timeline

Hello everyone. I am in trouble and hoping someone can possibly help me here....

I checked the USCIS website yesterday, and it says I am at "Request for Evidence" stage.

It says they mailed a letter on March 1st.

Haven't receive the letter yet, but my fiance made a phone call and asked them what is wrong.

The guy who answered the phone said we must submit more evidence that we met in last 2 years.

Well, here is the problem, or problems:

1. I am Japanese, who entered USA 3 years ago(as international student).

I am at home(Japan) now, but since I entered USA 3 years ago,

my passport stamp can't help me to prove we have met in last 2 years.

2. For 1st year and half I was living with my fiance in Utah. The problem is, we were living at his mother's house(with his family).

So I have no hotel bill or anything like that whatsoever.

And how am I suppose to prove I was living at his mother's house...?

3. After that he joined in the military, so I was in Utah and he was like in different places.

I did fly where he was, to see him, once or twice.

But of course, I have no stamps on my passport for that(I was in USA also),

and I only have receipt saying I purchased the ticket online

(you know those "confirmation e-mail" thing you receive, with info of your flight?).

At that time I wasn't planning to get fiance visa so...

4. Before we submitted I-129F thing, my fiance who was in SC at that time came to Utah to see me.

So I submitted the receipt of his ticket, and a picture of him and me standing at airport info board

(on the board shows the date and time like "12/20 2009")

Again, he and I stayed at his mother's house so no hotel receipt or anything...

I am worried sick...oh dear! What am I gonna do?

Could anyone suggest me what I can possibly submit for them?
