An RFE is issued at the USCIS stage of the petition. They are requesting more evidence to help them to decide on your petition. If you're close to interview that means your petition has already been approved.

Can you please explain that ?

It means that if the Embassy has sent you packet 3, you should have already received NOA2 and have been through NVC stage as well. You should have had a hard copy of your NOA2 approval in the post as well as a letter from NVC to tell you that your case has been forwarded to the Embassy in Bucharest.

On another note, I just wanted to make a comment for people worried about RFE. Shortly after we sent our petition to VSC, we found VJ and realised we made number of mistakes on our forms. We were certain we would get a RFE because he (petitioner) signed my G-325a form (or whatever it's called, sorry I forgot the correct number now). We did get a RFE but for a completely different reason. Apparently we omitted to tick a box (I think it’s in Part 2 (about ever being convicted). It's buried with all other text and we both failed to notice that it hadn't been ticked. Well, no wonder we got a RFE!!! :wacko: But 49 days after the case processing resumed, we got our NOA2! I suppose they needed to do extra check to make sure he wasn't making it up. :)

RFE can be a nuisance but they are not insurmountable obstacles. Just a little blip on the long journey.

We filed a few days ago and we didnt include a copy of my boarding pass when I went to Alaska earlier this year. However, I did write down the departure number on my green VWP sheet which I wouldnt be able to obtain if I didnt go through United States Customs. We also didnt specify exactly how we met online, we specified dates but we just said we met online.

Will we get a RFE?

most probably not...not including a boarding pass will definitely not get you an RFE...but did you include passport pages stamped? The USCIS just wants proof that you met within 2 years of filing...whether that is in the form of boarding passes or copies of passport pages stamped<this is a more authentic source than the boarding passes...

And about how you did not specify how you met online...did you write your statement of meeting on a sheet of paper? notarized? It depends on how much info you included, the more details, the better...but there is no saying Yes/No you will/won't get an RFE for this part...depends on the officer reviewing your file...

But no need to worry, you will be fine!

I see, hopefully everything will go fine.

Were also a little confused about birth certificates, is there a way to speed the process up on getting the full certificate? We only used the small one because at the time we didnt even know a full one existed in Alaska.

I just filed for K-1 visa for my fiance. and just realized after looking at the copies of the documents that I made, on fiance letter of intent I made grammar error. I accidentally said: I intend to marry within 90 days of my arrival into the US using the K-1 visa. but I am the one applying for him. do you think I could get RFE for this?

hello everyone.. i would just like to know if in case an I-129F was not approved or denied due to 'not filing the I-129F within the 2 year period of last meeting(e.g., jan'07 last met, filed I-129F feb'09)', would it be allowed to reapply the I-129F petition for the same beneficiary again? are there any rules/procedures on reapplying for I129F?

hoping for some reply on this..

thanks ELW for your reply.. it gave us hope again..

our only mistake in our application was filing it after the 2year period.. we took it that way, instead of filing it within the 2year period.. me and my fiance have known each other for a long time since we were classmates in highschool.. it is just that we've been waiting to be together for a long time.. and this whole process is just really frustating at times.. but then again it's good to know that we can reapply.

i still have one more question:

i will visit my fiance this May 2009 and we haven't received the decision yet from the USCIS..

if we received a decision by the end of May, would there be a problem if we reapply by June 2009? would it not raise a red flag during the process, like they might think that my fiance only visited me after the denial so that we could pursue our visa journey?

are the procedures for reapplying the same as those when you first apply for I-129F?

is it ok if we just cancel the I-129F for reason that we have not met the 2 year requirement? will it be allowed if we send the letter of cancellation in response to the RFE that they sent us? how long will it take before we received the notice from the USCIS that our petition was cancelled? please help enlighten me on this one..

I don't have experience in this matter - better you start a new thread on this same forum (K1 Process) - probably there are others out there to give you good advice!

When did you file? Did you specifically tell them the last time you met, which was over 2 years ago? I think yes, you can write to withdraw the application on the basis that you haven't met in the last two years. Then you can reapply immediately after you have met again. You have known each other for so long, there won't be any red flags. I am sure your process will go smoothly after you meet again. :thumbs:

here's my timeline:

nov 2006 - last met

12/30/08 - I-129F was received by VSC

01/02/09 - NOA1

4/13/09 -RFE requesting initial evidence that we met between Dec 30, 2006-Dec 30, 2008..(which we cannot provide)

..before the RFE was sent to us, I already booked a flight to visit my fiancee this May.. there are two things that i'm considering now:

1. if we send a letter of cancellation as a response to the RFE, should we wait for the notice from the USCIS that our petition was already cancelled before we can send our new application? or can we reapply eventhough we didn't receive a notice that our 1st application was cancelled? how long will the notice of cancellation be sent to us?

2. or should we just wait for their decision to deny it and then reapply? how long before they'll send us the notice to deny?

we are choosing between the two whichever is shorter in timeframe before we can reapply..

I would suggest the fastest thing is to answer the RFE with a request to cancel your application due to not meeting within two years. I am not sure if you have to wait for a reply or whether you can immediately (after meeting) send in your new application. Please copy your above post, click on NEW TOPIC button below, and paste in what you wrote and post that new thread. Others will give you advice. Not many people read this long RFE Master List topic. Hey I'm new to the site. My fiance is Canadian and in college right now and I'm an American citizen. He's heard some things from his mom's friend who used to live in the states before moving back up to Canada. But I'm still confused for most part on the forms and the whole deal with him not being able to even visit Canada for a year (I live in a boarder state at the most 1.5hrs from the Canadian boarder) what exactly are the rules and regulations to everything?
