We got an RFE on the 31st of Oct. They were requesting a translated copy of my fiancee's birth certificate. Something we could have given them at the outset had we known they would decide they needed it.

Is your fiancee the petitioner or the beneficiary?

She is the beneficiary.

I think all documents if not in English language, has to be translated. Well that is what i did, because i do not expect the American authorities to learn Swedish.

And for the interview if it is asked, police certificate, it will be a good idea to translate it too.

I think all documents if not in English language, has to be translated. Well that is what i did, because i do not expect the American authorities to learn Swedish.

We were asked for the translated copy while at the CSC waiting for NOA2. We didn't send it in because it was not something that is asked for when you send your petition in.

Question, had you included her BC (not translated) when you sent in the original package??? Or was it they asked for it out right??

The reason I ask is that in the instructions there is no mention of the Fiance's BC to begin with.

I didn't send in with the petition because it was not asked for. They decided to ask for it 4 months later.

I got my RFE in the mail today - I need to send my entire divorce final decree...in my state we have a shorter divorce decree and I had sent that instead of hte longer final decree...FYI for anyone else...I saw another post asking for the same thing......

We're in Maine and my now wife's divorce decree mentioned an appeal period so in I-129F processing VSC said it wasn't a final decree.

However, in my wife's case (or in all cases in Maine) there was no additional, final decree. So, as advised by USCIS (or whomever she spoke with), she got her divorce attorney to write a letter explaining that there was no appeal and the divorce is final.

So, any Maine divorcees wanting to remarry an alien might want to check their divorce decree and, if there's an appeal period mentioned, get an attorney's letter.

That may be excellent advice for some situations, but not "always". In our case, we went through the whole process without ever sending in the USC's birth certificate at all (we used the passport to provide proof of citizenship).

Oh no. I sent only the "short form" of my birth certificate. Our state does have a long form option but it takes 6 weeks to obtain. And I didn't send copies of my passport pages.

Is it possible to make an addendum to an I-129F that's waiting for review. I already received NOA1 with case number. I wonder if I can "pre-empt" the RFE by sending my passport copies?

yeah.... umm... I tried that.... with evidence of work status, etc, and it got SENT BACK TO ME... stating that they do not yet need the letter but rather once it is approved and sent to the Dpt of State, that is apparently when they will ask me to prove fianancial info.... not sure if they will accept further evidence that's non-financial though... it's certainly worth a try!!! :thumbs:

I sent in only my US passport, copies of every page, but no BC at all (I only have the "short form"), and got approved fine. Make the passport copies and keep them safe. If you get an RFE, you can send them in. Otherwise, just make sure you send the passport copies to the Consulate when your honey has an interview. :yes:

My fiance (USC) sent pictures to prove that we met each other. However, now, I found a huge problem. He sent 6 pictures. and once of the pictures has a wrong date. He put 07/10/2006. But, I returned to Japan on 07/08/2006. It does not make any sense. I guess he was remembering as much as he could, but the date was on the back of the picture. He totally missed the date. He got the pictures from walgreens and that picture was only taken by his cellphone and it is obvious that the date was there. But, it was very weakly printed and he thought that that was a picture's number or something. Then, he checked 2006 calender, tried his best to remeber, well, too bad, it was wrong.

He did not even check the dates with copies of my passport stamps and sent it. We had a huge fight about this issue last night and I am so worried that what if we get denied.

If I am asked, I will explain that that was a mistake and the correct date was on the back of the picture and his written date was wrong date. Well, should I call USCIS? Ahh, I might get RFE but how should I explain?

I would not worry too much about it. Don't call up USCIS (when you contact them unasked, it only confuses them and complicates the case) and if later you are asked in an RFE, he can just explain the truth. There were no dates on the pictures I took with a cheap camera in India. When I sent in the K1 application, I guessed an approximate date and wrote it on the photo. Then when I sent in the same photos that were submitted at the Consulate for the interview, I could not find any copy of what I had submitted with the I-129F, so I had to guess the dates again, which were different! No one asked me about it and all went smoothly. So you two kiss and make up, it is an honest mistake he made, under the stress of paperwork, poor guy. No big deal. :no:

I'm trying to figure out how much Primary Evidence I sent in and if it was enough. I sent in lots of secondary evidence ie. photos and ring receipt that was purchased on my card in the uk, but the following I've assumed is Primary.....am I wrong?

Travel Itinary when we went on holiday together.

A copy of my UK work permit (stamped)

Copy of our lease with a signed witness

Copies of her's and my british driver's license and counter part showing we lived together (matching address)

Copies of some of our Council Tax with both of our names present.

and finally our letter of intent is notarized showing we were both present at the solicitors office to sign it and the notary witnessed it.

So are any of the above not primary?? Unfortunately i never kept any tickets or receipts as I didn't even know what a K1 was until 4 months ago.

Copies of Passports that show entry into countries you've visited together, or when you visited eachother's country, are also very useful. Thats one we used, and on the photocopy pages I just noted that he visited me from this date to this date, etc. You should be good with the other things you described, in addition to passport copies.

ELW, you are so sweet. I know I yelled at him so badly. I also made mistakes on G325A which I was supposed to put 2005, I put 005 on the attachment. The addressed that I put past 5 years are confusing because I lived with him but, I spent a few nights at my friend's house for commuting instead of staying at motels. I did not have a car at that time. So it seems that I used to have two addresses. Of course I explained that on the attachment. I hope that they do not complain and ask me more questions. I was an international student. well, hopefully nothing will bug me;(
