Last time I only sent in my itinerary because I was in the U.S while we sent out the packet but this time I will send the Boardingpasses as well...because I flew already back home, before I din't had my boarding passes...do you have any other idea what we should send??

Thank you so much for your help!!!

Nina

The itinerary definitely won't be enough. Anyone can produce an itinerary without having done any travel at all. Boarding passes are very good proof given they are difficult to fake and actually proves that you traveled.

Primary evidence:

Exit/entry visa stamps, airline ticket boarding passes, hotel receipts, ATM withdrawals in the subject country/city, apartment leases in both names, utility bills, etc. (for those that have lived together) are irrefutable as primary evidence.

Secondary evidence:

Photos, bus tickets, engagement ring receipts, affidavits from family/friends may be used to supplement weak primary evidence if the primary evidence can not stand alone on its own merits.

Not at all. I was asking basically if you sent any record of purchase of the ticket. Also did you print anything out showing the itinerary. Just trying to offer up some suggestions.

and my passport entry stamps and so forth, so I'll be adding those, as well.

Thanks! I appreciate your thoughts.

This is very good evidence but remember that if you traveled to someplace other than where your fiance(e) lives, say someplace in between e.g. a different city, a third country whereby it is clear you were there but it's not clear that your S.O. was also there at the same time, then all the passport entry /exit stamps and airline boarding passes in the world won't make your case.

I'm not sure if this situation applies to you but if it does be sure to prove somehow that both of you were there, wherever "there" might have been, at the same time.

It is probably best to explain your evidence piece by piece on a separate piece of paper, particularly if your travels were difficult to understand.

P.S. The affidavits from family/friends can't hurt as well as an explanation from you that you stayed with him/her and did not use hotels, etc.

What if you have a boarding pass to a different city than your fiancee lives in? It's rather hard to get a flight to Boondockyville, Idaho.

A different city is OK, the main thing is the COUNTRY. I landed in a city a good 12 hours bus journey from where my fiance lived, and had no problem.

LOL yeah, I could see a different country being a problem.

Twice I flew to Chicago and took the bus down to South Bend to meet my fiancee. We then went to her town. We explained this in the I-129F and it was approved. That's why I wondered what this was all about. I'm glad you had no problem too.

That may be excellent advice for some situations, but not "always". In our case, we went through the whole process without ever sending in the USC's birth certificate at all (we used the passport to provide proof of citizenship).

Oh no. I sent only the "short form" of my birth certificate. Our state does have a long form option but it takes 6 weeks to obtain. And I didn't send copies of my passport pages.

Is it possible to make an addendum to an I-129F that's waiting for review. I already received NOA1 with case number. I wonder if I can "pre-empt" the RFE by sending my passport copies?

Thanks,

3AD

I think as long as you send it in with your A# on each page with a cover letter of explanation (also with the A# listed) they should be able to connect the file with your additional information. Make sure your names are on EACH page you send. Along with the phrase "originals available upon request"

Add this one to the list. The US citizen must show proof that they are a US citizen. We already know that but they are pretty picky so your birth certificate MUST show BOTH parents names. Fortunately I had already ordered the long forms and they arrived while we were waiting but my opinion is GO GET YOUR PASSPORT!!!!

I thought that we could send the copy of the passport in place of a birth certificate, I believe that was on the instructions for the I-129F? Is this correct or will I get a an RFE? Thanks, Milena.

I can top this one. I am still waiting on my RFE. Filed for NOA1 on 24 April (VSC). Called the VSC two weeks ago and they said that an RFE is in process. Not gone to clerical yet which they claim can take two weeks and then mailed another 2 weeks. I asked what on earth it was for as we have sent in everything. I mean everything. Long form birth certificate, passport stamps for the past THREE years (past the two year guideline), photos, (we have a website as well and have had one for two years), social security card copy, military ID copy with MY picture and Social Security number on that as well, statements from friends and family members as to our meetings in the past THREE years, letter from my employer (even though the Embassy is the financial decider), even though I am over the guidelines for finances we have a back up co-sponsor as well, my fiance' divorce decree from the UK and my divorce decree (signed and notarized by the Clerk of Courts with a current date). There response relative to the REF from the woman on the phone is that she does not have all of the details but she said that she is reading on the computer that my divorce was not final and that my name does not match up! Match up to what? A). you have my Birth Certificate, My military ID card with Photo, my passport photo...errr ummm am I a phigmant of my imagination? I pay taxes, I work full time, I have been part of the U.S. Military world (NAVY) for over 15 years! as for my divorce in question it was granted to me and signed by a judge of competent jurisdiction in 1997. I took it upon myself to go down to the court house this past Wednesday for another certified copy of my divorce papers and the clerk said you were here for this not too long ago and I said why yes I was and I explained why I was back. The clerk then said you are legally divorced and have been since June 3, 1997 and are free to marry per the laws that govern our state! So someone PLEASE tell me how VSC can claim that I am not! and that I am NOT ME! and lawyers they are not help. "We will just send them waht they need and in two weeks time or less after that you will have your NOA2. What kind of response is this? It still does not clear up how VSC puts out the info that they put and how they conjur up some of these things.

Frustrated is MY WORD for the day right now!

Did you include a copy of the marriage certificate from your previous marriage? If you changed your name with your first marriage, you should have included it in your I129f packet. If you didn't, that could be why they are saying that you aren't who you are ....the marriage cert shows your name changing from maiden to married name. As for why they state you aren't divorced? No clue! Just resend another cert copy of the divorce decree. Good luck!

RFE - May 2007

When we received the RFE, CSC requested three kinds of evidence:

a) 2" x 2" passport-style photographs

bee) Verification of Status

c) Proof we had met in person within the previous 24 months

I wanted to make this easy for CSC. I kept text simple and direct. To begin, I wrote a cover letter which followed the same format as my K-1 petition cover letter, but noted that both primary and secondary evidence were included. I also made a separate cover sheet for each of the three kinds of evidence requested. Each sheet had a header with my name, petitioner; his name, beneficiary; the A# issued for the RFE and our WAC #.

a) 2" x 2" Passport-Style Photos

Cover Sheet: Please find attached two 2"x2" passport-style photographs of MM and MS, as requested.

The photographs were inserted into a cardboard cover (used for passport applications), sealed in an envelope, and stapled to the cover sheet.

bee) Proof of US Citizenship

Cover Sheet: Please find attached a copy of my U.S. passport issued xx/xx/xxxx and which expires xx/xx/xxxx (identification page only). Please also find a copy of Certificate of Live Birth issued by the California Department of Health, San Francisco, as requested.

Both documents were copied and stapled to the cover sheet.

c) Proof of Having Met in Person Within the Previous 24 Months

Cover Sheet: Please find attached copies of

1. U.S. Passport identification page

2. U.S. Passport which shows Turkish Visa and Admission Stamps dated ...

3. Airline booking confirmations

4. Airline tickets

5. Airline Frequent Flyer statements

6. xx/xxxx Bank Statements (highlighted the purchases/ATM withdrawals made in Turkey during this period)

7. Hotel Receipts

8. Photographs of MM and MS taken in Istanbul, Turkey, in xx/xxxx and in xx/xxxx

9. Receipts from purchases made in Turkey

The photographs were original (printed from the memory card) and sealed in an envelope. Our names, the place, and dates were printed on the back of each photo. Copies were made of each document. Everything was stapled to the cover sheet in the order listed.

Thus, CSC received a cover letter and three smaller packets a), bee), and c) which included the evidence requested and the evidence provided. NOTE: The PO Box address for the RFE is different from the PO Box used for the K1 petition submittal. Secondly, factor an extra week for the day the parcel is collected from the post office box and the day CSC acknowledges that the RFE Reply was "received."

There are many ways to submit an RFE Reply. This is what I did, and it worked for us. Much good luck with your RFE!!

Call them to ask about it-or or I wait, wait, wait....I am really mad cause I sent in August 2, and now is August 20.

How long to get a RFE letter ? I have been waiting for more than a month since we got a email but nothing in our mail box yet.

My husband called asking for re-sent it 15 days ago !!

Please some advice ? Should we call again?

They claim that they cannot tell you what the RFE was for until it has been processed and sent to you. I called VSC almost daily until I was able to get a customer service rep to tell me. They only gave it to me in bits which made the entire ordeal even more maddening. We were told on 11 July that we were getting an RFE (via the telephone as I called relative to the lenght of time we had not been touched). It was almost a month later that we actually received the RFE. In our case they were asking for evidence that they had already received in the original package sent on 24 April. Talk about not being happy. We sent our RFE packet back by overnight Fed EX on the 13th of August. VSC signed for it on 14 August. Our profile in the USCIS sight claimed they received it on the 21st. However TODAY we received our NOA2 in the mail...well a copy as the original has gone to our Attorney.

One can never tell how things are going to go at these service centers.
