Checked my status online and saw that I had a RFE coming...was worried it was going to be something major. When I received the RFE I was both mad and relieved I didn't review well enough my submission and made two dumb mistakes...forgot to check item 15 "has your fiancé ever been in the US"...it is right in the middle of a bunch of stuff that didn't apply & she left the employment space blank on the G325A because she hasn't worked yet. Two things easily taken care of. Researched and found that I don't need her to send me a signed G325A back...I can just fix it and label it as she will sign during the interview. That saves a week and about $75 for shipping.

Eeeeps. I just got the photocopy of what I sent in and I saw that I skipped that one too. RFE for us :( I double and triple checked this thing, too.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

We got RFE asking for evidence from me (beneficiary) that I plan to marry within 90 days of admission to the US. Further in the letter clarified that the evidence may be a statement, wedding preparations or other evidence that clearly establishes the intent to marry. Easy!

Eeeeps. I just got the photocopy of what I sent in and I saw that I skipped that one too. RFE for us :( I double and triple checked this thing, too.

Sorry you made the mistake too...it is so easy to miss that little box. Well no problems with sending back the G325A unsigned...I just sent the Memorandum stating this and also added a note to make sure it was very clear. We are at NVC awaiting processing to the Embassy.

Same sex couples need to state in their application the STATE they intent to get married in, as our application generated an RFE for this reason -

"From the evidence, it is not clear where the petitioner and the beneficiary will wed. Therefore, please submit a statement indicating in which state the petitioner and the beneficiary intend to marry."

Nowhere is this asked in the I-129F, so get ahead of the game by supplying this information with the initial I-129F. I suggest modifying the "Statement of Intent to Marry" letter to read:

"I, ********, do hereby state that I am legally able and willing to marry ***********, and intend to do so within 90 days of his/ her arrival into the US using the K-1 visa. We intend to marry in the state of *Insert State where same sex marriage can be performed*."

In July 2015 the SCOTUS (Supreme Court Of The United State) is expected, though not guaranteed, to make a ruling in favour of full countrywide recognition of same sex marriages and that all states will be required to allow them to be performed. Until then, to avoid an RFE make sure you state in writing and plan on getting married in a State that allows same sex marriages.

We didn't, but I live in a state where same sex marriages are legal, so that could be why.

My partner lives in Ohio, which doesn't currently allow same sex marriages. We already knew that and have planned on marrying in West Virginia, which does. Travandlhen, like you we just used the VJ template and had no idea that this would be an issue until we got the RFE.

I got an RFE on 3/19/15 for not giving external evidence that FilipinoCupid.com is not an International Marriage Broker....

I met my fiancee on filipinocupid.com and this is the first I heard of needing to provide external evidence that this site is not an International Marriage Broker. Is this really necessary? If so, how do I go about proving that this site is not an International marriage Broker?

My RFE???? Read and help please

Photographs

Please submit a passport-style color photograph for the petitioner and the beneficiary. Each photograph must be:

Taken within 30 days of the date of this petition;

On plain white background;

Glossy;

Unretouched;

Not mounted;

Full frontal facial image;

And about one inch from the bottom of the chin to the top of the hair.

Print the name and A-number (if any) on the back of each photo.

Intent to marry

Submit evidence from the benefiaciary, that he plans to marry you within 90 days of his admission to the United States.. Evidence of the beneficiarys intent may be a statement, wedding preparations or other evidence that clearly establishes his intent to marry.

Please help me with this because i already send the passport photos and they are asking me for then again. And what can i do to establishes my intent to marry.

Tomorrow is the interview! Super nervous!! Hopefully will not get RFE! Because my husband doesn't have w-2 for 2014 and didn't have tax transcript but he started his business on March 2015 and just registered with BOard of equalization. And recent sales tax return has been done...

just wanna share our RFE,

its just a question, if my fiance have ever been convicted? answer is NO.

and thats it.

What if he/ she does ?
