I received the RFE hardcopy on 7/19. It says that on my original I-129F I stated that I had never filed an I-129F in the past and that their records indicate that I filed one for <unknown Japanese person's name> that was approved on 4/21/04. It then requests that I make a statement regarding that relationship. It then goes on to ask if I married her. In addition it states that I have filed three I-130 forms that were approved. Of course my G-325 I indicated that I have never been married, and it asked for a statement regarding my marital status.

I have never been married and until just last year had never seen or had a reason to file any of these forms. In fact, in April 2004 I was one month shy of graduating from university in Iowa where I lived on campus for all four years after graduating high school.

I am not entirely sure what kind of statement I can make about what they are requesting other than to flat out deny that I had ever done any of the things their "records" indicate. Shouldn't my personal info and SSN be enough for them to determine that their records are erroneous? I don't know what kind of documentation I can send to help clear that up.

Any suggestions would be greatly appreciated.

My Fiance and I had a similar RFE. It said that he had hada previous petition. He called USCIS and asked them what he should do, being that he never applied previously. They had told him to write a letter stating that this was his first peition.

Hope that helps.

And I agree... Shouldn't they know if you had applied or not. They have all of your information. It seems crazy.

Do not use a pen or marker that would appear to look like a photo copy when signing any of the forms or intent letters . I used a black Sharpie pen for my letter of intent . When I got the RFE letter I was annoyed , but after looking I can see the simple mistake . My blunder , but thought I would share it so maybe you can avoid it .

Hello VJers

I received a RFE hard copy today for our I-129F and it is requesting evidence for affidavits. The notice states " Please submit additional evidence, such as affidavits to establish that the beneficiary is entitled to the benefit being sought. Affidavits must be sworn to or affirmed under the penalty of perjury by two persons who were living at the time of the event and who have personal knowledge of the event that you are trying to prove. The affidavit should contain the following information regarding the person making the affidavit: his or her full name and address, date and placed of birth, relationship to you; if any; full information concerning the event; and complete details how she acquired knowledge of the event. The persons making the affidavits need not to be US citizens.

Has anyone received an RFE such as this and if so how did you rectify the situation?

Question.. what event are they referring too?

Hi,

Just wanted to see if anyone else had received the same Request for Evidence that we did....

We were transferred from Vermont to texas in the May transfers. Got a Request for Evidence on the 2nd July and received the paper copy on the 6th July.

They are requesting more passport photos? We made sure we provided one passport photo for each of us with our names on the back, placed in a bag and placed behind the G325A. I have rechecked the USCIS website to check this is still correct...it is.

Anyway the RFE says

PHOTOS

Please submit TWO IDENTICAL PASSPORT STYLE PHOTOS

*Using pencil or felt pen, lightly print the name on the back of the photo

*Enclose the photos in a paper envelope

*Staple the envelope to this notice when returning it to this office

I wonder why they want more photos? Also do you think they want photos from both of us or just the petitioner or just me? It's a good job I got some more done the last time I was there but still have to get them sent to my fiance before he can get it all sent off.

More delays....

I got the exact same RFE on 7/25. I'm sure that i did have my pictures inlcuded in my i-129F submission and they met the requirements of passport photos and less than 6 months old. Maybe they got lost during transfer? Anyway, Have you got approved yet? Good luck to us all

Hi,

Sorry to hear you got the same RFE as us...it's a pain and a delay when I don't think it's anything we've done wrong! I think something happened to the photos....like you say...either lost in the transfer or they've damaged them while sorting through the case.

Anyway what will be will be! We got the RFE on the 2nd July...hard copy turned up on the 6th July. I then had to post off my passport photos on the 8th July. My fiance (USC) finally got to send the evidence back on Monday 15th July. We got email to say they had received them back and were carrying on with the review on the 19th July (Friday).....then an anxious wait....till I woke up on Thursday 25th to find an approval email dated 24th July!!!

So delayed us maybe 3 weeks but we got there in the end......196 days later!!!

Good luck with yours and hope you get the same happy result! Now on to the next stage........................

Thanks for the quick response. So only 6 days after they received the RFE response (7/19), you got approved. That was fast. I hope i will get approved soon. For the time being, i'm just gonna keep praying :) Good luck on the rest of your journey

Hello everyone to those who got RFE.

My fiance received an RFE asking about affidavit from friends. what we did is asked our friends to write a letter and sign them. Whoever here has the same RFE like ours please share your experience. I need to be enlightened if we did the right thing. Thank you.

This is where this thread is going to confuse many. Getting an RFE for lack of evidence to prove you have met in the past two years almost always is due to a lack of primary evidence. Supplying more, or many photos (secondary evidence) will usually not overcome the burden of proof.

This has been borne out time and again by USCIS decisions whereby they have found mostly in favor of primary evidence and rejected secondary evidence such as photos when submitted as sole proof.

Primary evidence is documentary in nature: airline boarding passes, passport exit/entry stamps, hotel receipts, atm withdrawals in city of question, utility bills, apartment leases, etc.

Secondary evidence The USCIS defines secondary evidence as any documentation that can be used to supplement primary evidence but in itself cannot stand alone to prove ones assertions.

Photos are secondary; so are letters from relatives, neighbors or acquaintances, bus/train tickets and essentially anything that cannot be used to prove your point with a very high degree of certainty.

To sum up; very good Primary evidence with some secondary evidence = NO RFE

very weak Primary evidence with some, or lots of secondary= Possible RFE

No Primary evidence..........................................................= RFE

No Primary, lots of secondary.............................................= RFE

We have almost all our forms and supporting documents together for the I-129F K1 Fiance Visa Application. For the supplemental documents to prove that we've visited in the last two years, I have my passport and emails of confirmed itineraries from travel and airline companies.

My fiance who is Dutch received his new Dutch passport about 6 months ago, but has lost his old passport with all the stamps proving all the times he's visited me or we've traveled together in the past two years (which has been about a dozen times since he met me in 2010) The new passport only shows him visiting me in Chicago twice these past 6 months.

He's going to look for it again over the weekend, but what if he never finds the old passport? Are his emailed itineraries from airline companies enough? Also, I don't think either of us really kept any physical boarding passes either. Would just my emailed travel itineraries, my passport stamps, and his emailed travel itineraries be enough for primary evidence?
