Hi everyone!

For the purpose of adoption, can a child whose parents are separated but still alive but the father has not been supportive financially and the mother physically challenged file for and approve fro US in one of the non-hague countries? I'm a US citizen and I intend to adopt my sister's son whose huband has not been responsible for the child welfare. My sister is physically challenged. what is the likelihood that the case will be approved fro US adoption?

Under U.S. immigration law, an orphan is a foreign-born child who:

  • does not have any parents because of the death or disappearance of, abandonment or desertion by, or separation or loss from, both parents doesn' apply to this case

    OR
  • has a sole or surviving parent who is unable to care for the child, consistent with the local standards of the foreign sending country, and who has, in writing, irrevocably released the child for emigration and adoption child has two parents living and both seem capable of caring for the child

Adoption used to be a way to bypass long wait , now they have made it so that the adoption of a related child with any living parents rarely qualifies that child for adoption. Your money is better spent providing support in country as the money will go much further there.

This will not be over quickly. You will not enjoy this.

It would likely be cheaper for you to provide the child with a good boarding school in the home country.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
