He wont be able to work until you guys are married, then file your adjustment of status, ead, and advance parole. Until those are approved he/she will sit at home

9/01/15 AOS Interview Houston-APPROVED!

9/01/15 Card in production, Welcome notice has been mailed

9/05/15 Welcome Notice Received

9/08/15 Greencard was mailed

9/10/15 GREENCARD RECEIVED!!!!!!!!

7/1/17 I-751 returned rejected (multiple items)

7/3/17 I-751 mailed again with signature confirmation

Sit at home? Why? There are many things to do besides sit at home.

Why request A P at that time?

Request ap in case there us a family emergency and they have to return home

Hi,

I was reading the posts of K1 and like to know if Fiance' can work on K-1 visa if he gets approved and is in USA?

The K 1 is used to enter the USA for marriage within 90 days. You could marry quickly and the next day file the AOS with the other docs to get the EAD card as well which if done at the same time is free. The EAD card should come in about 90 days, allowing the person to work until the green card is approved and issued.

There is no need to sit at home doing nothing. Better to start now to figure out what else can be done that is productive.

I hope you read enough of those posts to discover how difficult the K 1 process is in India. It can be done but sometimes it is very difficult if there is any question about the relationship. Religion, cast ect always come up. Prepare your case carefully.

I can look at the information about visa process and procedures, but like to know from them who actually been through K1 visa process and the time it took for her/his fiance' to work and on which visa.

You must be having problems understanding what you are reading because the simple fact is K 1 visa does NOT allow people with that visa to work.

I have no problems understanding. I understand K1 visa DOESN't allow to work

The beneficiary will be able to work with their employment authorisation document (EAD) or green card. As Janet said, EAD is free to apply with AOS for K1 visa holders. The time to begin working is dependent on when you marry and when you file AOS with EAD/AP. After filing your AOS it takes about 3 months to receive your EAD/AP card, which allows you to work.

K-1
NOA1: 04/08/2014; NOA2: 04/21/2014; Visa interview, approved: 07/15/2014; POE: 07/25/2014; Marriage: 09/05/2014

Since you recently joined VJ, I invite you to review the timeline section, starting with folk who started with a K-1, went through the AOS process, and had green card delivered.

Once you have a good understanding of the process and timing, you can forecast that 'first available working date' for your foreign spouse.

I came on K1, got married and filed for GC, EAD and AP with a date of 4 Nov. So 54 days now and nothing so far other than the NOA1's which are all dated 4 Nov. So I cannot work here yet or go abroad to work and come back. Hope this gives you an idea from someone who is in the process you are talking about right now.

Filing for the EAD before filing for AOS is a pointless waste of $380. It takes 2-3 months to receive after filing and your I-94 expires in 90 days. That is also when that type of EAD( category(a )(6 ) ) would expire, so you would have very little to no time at all to actually work. File for the EAD (and AP too) when you file for AOS. The fees for the EAD and AP forms are waived when filed with a pending I-485 for adjustment and that type of EAD( category (c )(9 ) ) will not expire for a year.

If working first thing after entry to the US is important, then you should consider getting married and filing for a spousal visa instead.
