Guys, I am preparing for AOS package and i am getting mix information since the new 260 process started. Some people say we need to include W2 and some people say you dont. Can someone confirm if anything is needed for AOS besides what is listed below?

1) 864EZ; signed and dated.

2) IRS Tax return transcript Most recent year (NOT THE ACCOUNT TRANSCRIPT)

3) Employment letter

as long as your income is enough to support the beneficiary

- barcode cover sheet..

-last 3 years of tax returns, or tax transcripts which you can request for free from IRS ,

-w2's for last 3 years...

-I also included 3-4 latest paystubs which shows what I've made so far this year since this years taxes havent been filed yet.

hey sun,

Do you know why we need to send three years as per the 864ez-form, they only ask for most recent year Tax return. Also, it does not mention anything about W2 but simply IRS tax return or tax return with all the schedules with W2. Is it just me or am i reading that we dont need to send W2's if the tax return transcript is sent from IRS?

I believe all of the 864's only ask for one year of tax forms but from what i've read its better to send last 3 years. I sent in w2's and paystubs also as extras just incase. they may not be needed but its better to send extra proof of support then to not have enough.

From the Instructions:

You must provide either an IRS transcript or a photocopy
from your own records of your Federal individual income
tax return for the most recent tax year. If you believe
additional returns may help you to establish your ability to
maintain sufficient income, you may submit transcripts or
photocopies of your Federal individual income tax returns
for the three most recent years.
If you provide a photocopy of your tax return(s), you
must include a copy of each and every FormW-2 and
Form 1099 that relates to your return(s). Do not include
copies of these Forms if you provide an IRS transcript of
your return(s) rather than a photocopy.
Obtaining Tax Transcripts.
You may use Internal
Revenue Service (IRS) Form 4506-T to request tax
transcripts from the IRS. Complete IRS Form 4506-T
with the ending date for each of your three most recent
tax years listed on line 9. Follow all instructions for
completing and filing Form 4506-T with the IRS

W2 inclusion solely in an either/or construct.

It's

1. Tax Transcript or

2. complete copy of income tax return

A W2 is part of an income tax return.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
