Citizenship after divorce

I had my interview on November 22nd. The IO officer asked me a lot of question about my divorce. My Original GC was based on my marriage to a US citizen. The IO told me that he suspect on me because there is a 37 days gap between the day i received my 10-years GC(Remove the condition on my GC before divorce) and divorce filing date. I pass my interview but at the end he said that we need to review your documents and it will take 3 to 4 weeks. its been 5 weeks now but still i have not heard anything from USCIS. Our marriage was in good faith for 2 and half years but we had some family issues between us. So, we decided to go for divorce and end our marriage relationship.

Does anyone have any idea what to do & how do i check my status or how to get an update on my case?

I have the originals of all document i submitted, when i filed for removing the condition on my GC.

What kind of review they will do here and how much time it would take to get this done?

Thank you.

He suspects that you faked a marriage until ROC and filed immiedately after. so that your ROC was not properly issued based on a viable marriage ( I doubt your marriage fell apart so close to granting of ROC ) If he finds that you misrepresented yourself for ROC he can find that you are not eligible for citizenship. It doesn't happen very often but could.

Thanks for the reply.

when i filled for removing the condition, during that time we did not have any problem and it was in august 2010. And then everything started falling aprt in january 2011. Sometimes we do not have control on whats going on in our life.

During my remove condition steps, we had everything together, like our joint lease agreement, join credit cards, join health insurance, join car insurance, 401(K) beneficiary was my spouce, join bank accounts and their statements, couple of trip photos during our 2 and half years of marriage. Thease all documents, i have sent during that time. Also i have those originals with me.

I have no idea how much time this would take or if they need something.

Does anyone have this kind of similar situation?

Did you go to an interview ? If so how close was it to the filing of the divorce. If you were in the office as a couple presenting items saying look we have a valid marriage then filed for divorce a month later they are seeing the interview as fraud. If you were approved without an interview there may be less of an issue ( but you would have been better filing for divorce and then interviewing based on a waiver )

We did not had an interview during the remove conditon step. i received my 10 year GC in december 2010 and we filled for divoce in january 2011. there is a gap of 37 days between these 2. As i said everything was started falling around in january 2011 as well. and we both agreed to get divorce and had a mutual seperation.

I am in similar situation as you Neal 18 but my interview isn't till February.

I got married in June 2008 and got my GC feb 2009. I got my 10 year feb 2011 and June 2011 I was divorced. My divorce had a gap of 4 months between and I have always wondered if I was going to have a problem with it when it was time for me to naturalize but here is how my situation is different from yours. My then husband divorced me because we could not have kids and he had met someone else whom he had gotten pregnant in November 2010 and hidden it from me. This woman wasnt living in the USA but our home country Africa. When I found out he denied and denied till it caught up with him and we finally got divorced. My ex husband has written a notarized letter for me explaining the situation which led to our divorce just incase I face any problems and has even added the child's birth certifiable to prove. So my advice o you is if you can let your ex spouse write a letter that will be great. A lawyer gave me that advice and apparently it has worked for people with no problems.

Anyway note that my ex husband now lives with this woman here in the US whom he filed for and was asked 0 questions. I pray it goes well for you same as me and every other person... I know what it's like especially when you know your marriage is not or was not fraud to begin with.

Thank you babfela for your input in this matter.

As you suggested to get a later from my ex-spouse, which is quite really hard for me to get it due to she got married with another guy and living with him as of now. I am pretty much sure that she wont write up any letter in favour of me.

The only thing i can consider of that she did appear on the court date which proves that me and her both wanted to get divorce due to the problems got started in january 2011.

Lets see, i am still waiting from USCIS to send me something in a mail. So, that i would know what is going on or what would be the matter with my case. Currently i have no idea what is going on with my case. I might plan to schdule an infopass appointment in early date of 2nd week of january(Completing almost my 6 weeks by then). Let's see what they have to say about my case.

Let me know if you get any handful information or suggestion in this matter. I appreciate for that.

Hi tadli77

sooner i will be completing my 10th week and will enter into my 11th week. Last week i called the uscis 800 number on friday and the IO told me that currently you are placed in queue. So, i asked him about howmuch time it will take and he told me that you have to wait atleast 90 days and you still have few weeks left for that.......and the normal wait time is 120 days after the interview date. So, i am hoping that before my 12th week which will be my 90 days time period, i will hear something from them.

I asked him about whether or not the additional documents are being requested on my case, he said at this time nothing is requested for your case.

I crossed my fingure now that i will hear something in the next week which will be my 11th week.
