With tax season eagerly awaiting us in 2014, I'm not sure what I should do. We are at the NVC step and should be finished with it by the end of January or beginning of Feb. If hubby's interview gets scheduled for March or April, should I just file an extension and wait til he gets his SSN so I can file jointly. I've heard it takes up to 8 weeks to get an ITIN and in that time he may already have an SSN.

Also, we are not yet at the point of submitting the I-864...if they call for it to be submitted in Jan. 2014...I would now need to provide tax returns for 2013, 2012, 2011....but how can I provide returns for 2013 if I haven't yet submitted them or if I file for an extension? Can I still just provide 2012, 2011, 2010?

Oh the joy of doing all this right in the middle of tax season!

If you submit the I-864 in January, you would not be required or expected to provide 2013 tax returns. Such returns would not be expected until after April 15th.

Use the 2012 / 2011 / 2010 return's, leave 2013 returns out, because you havent filed yet, etc..

Also, you can do your taxes where ever you do them, and file married but separately, since he does have a SSN right now, and after he come's and gets a SSN you can go back and they can "Amend" your tax return, and you will get a bigger return. (that's what the tax guy told me last year when i went) ask and see what they recommend.

NVC will need the tax from's before you can even file for 2013 taxes, so dont worry about 2013.

I am using 2012 / 2011 / 2010 returns.

In the meantime you can call IRS or look online and request the past 3 year's Tax Transcript's they take about 2 weeks to get them and there free,

i got mine already for 2012 / 2011 / 2010 Transcripts

I believe there are qualifications to meet in order to use the I-864EZ, you can check in the NVC January Filers thread...the first & second posts of the thread.

From what I've researched now and been advised that I will use 2010. 2011. 2012 tax forms since I will not be able to receive the tax transcripts from 2013 until much later in the year. I am currently thinking to file for an extension for my 2013 taxes so I can do it when my husband gets to the US, but if the time frame doesn't work out, I will simply file as Married Filing Seperately for 2013, and then amend once he comes to the US. If I have filed before his interview, then I will just have him carry a copy of my 1040 with him to show that I have filed, even though the transcripts won't be in considerations for the financial support. Just to show, I am a law-abiding citizen and including him in my tax filing. :-)

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Everyone has told me that NVC won't expect 2013 tax docs if I am called to submit the I-864 before April 2014. We should be close to receiving our case #, so I'm thinking that will be the case. They can't very well request tax docs for a year the IRS haven't even requested for yet.

Seems like we're always just waiting on all these government agencies...USCIS, NVC, IRS, etc etc. :-/

Ya, here's the PITA.

NVC Doc case complete prior to 15 APR 2014? No problem with NVC.

Interview after 15 APR 2014? Some problem with the IV Unit, if no tax docs for TaxYear 2013.

Sure, it's the first o january now, but since you have no movement on your official timeline, it very well may be you not have any interview set till after 15 APR 2014.

Hey Darnell, my interview was in June after a case complete in April (April 15th to be exact) and I wasn't asked for any updated tax documents or forms from the NVC or the consulate. I brought a copy of my husband's tax extension approval but it wasn't needed. Another country's embassy or consulate may need it though, so it is a good idea to have those updated forms and documents for interview day, I agree.

That is good to hear. I think the best bet is just to be prepared with whatever tax docs I can get if interview happens after April tax deadline.

I've never been a fan of extensions since you have to pay by April 15th and file later. I hate taxes so once and done is my preferred approach. You can file the 1040 as soon as you get your docs and apply for the itin simultaneously. Make photocopies and attach to a revised 864.

The advantage is you get a preferential tax rate (joint) and you are done.

In my mind the only reason to delay is if you owe. Having the 2013 return may not be needed for immigration reasons but in my mind minimizing taxes (legally) is almost as important as the visa. Kidding of course...
