So my wife wants to keep her last name and I am okay with that because is how we do it back in our country, but I am concern that imigration will suspect anything(fraud).

Do I have to worry about this, does she need to have my last name in order to prove everything if for love and not for papers? Has anyone have problems keeping their wife same last name and not the marriage name? Just let me know if this is okay, thank you.

Ps" Her ssn shows her last name and I have not done AOS yet, so I am wondering if keeping her last name the same will make imigration suspicious?

I am the USC and didn't change my last name after I married my husband (a month ago). He just filed his AOS and the I-864 has my maiden name all over it. My immigration attorney said it definitely looks good when the woman takes the man's last name, but it's not required. During the interview, they'll be more concerned about proving that we're living together and have an open, bona fide relationship. In addition, your wife could have issues if she's the immigrant and trying to change her last name. My co-worker had some trouble getting her social security card and license under her new last name. Others seem to not face any issues though. I chose to wait until we're done with immigration to change my name so that everything is uniform, clear, and concise.

Ironically my wife kept her maiden name until she decided to use her married name at her citizenship interview. It didn't make any difference to the USCIS. I don't know why she wanted to use her maiden name, never asked her. Maybe she thought I was going to kick her out and would have had to go to the effort of switching it back. LOL, just speculating.

To switch from her maiden to married name, all she had to do was to write in the first line, no court order or anything like that. And was the same with SS, still has the same number.

On our joint 1040 IRS return, instead of typing in her maiden name, typed in her married name. IRS requires you to use the same name on your SS card. But even using her maiden name, we still filed a joint return and as a married couple. IRS doesn't care either, just that whatever name you use is the same name on your SS card.

With her place of birth on her US passport, she is forced by our DOS with an agreement with her home country to maintain her home countries passport to visit, and thus her home countries ID. Was way to expensive to change her home countries ID, so her home country said just to use her maiden name. So when she visits, carries her home countries passport and citizen ID with her. As well as her US passport and driver's license with her married name on it. They don't car, because she has a photo ID for both countries.

I don't care either, matter a fact, like it, more fun to travel with my girlfriend than with my wife.
