Are YOU looking to write the exam too or just your husband?

If just your husband, then your husband should just go.

If you both, then what is the problem? You both seem to have stable jobs in PI so I am sure you have strong ties.

The tourist visa is the option for YOU to go, it sounds like your husband can go when he feels like it, being a citizen and all

It all depends on what your intentions are. If you are just coming to visit and take an exam, then you will need to apply for a tourist visa.

If you are intending to move to the US and live, then your husband would file an I-130 petition for a spousal visa.

My parents Have migrated to the US last Sept2013. That gave me a zero family ties in our country since Im an only child.

Hi! How long does it usually take to get an approval for CR1? My husband is filing a petition for me. But he is not based in the US, he is a dual citizen and currently works as a doctor in the Philippines. By the way, Im from Leyte Philippenes. We were badly affected by the typhoon.

Hello everyone! I just would like to know if the benefits of being a US citizen is the same for those who are US based and those based in foreign country. My husband is born in the Philippines and works here too. He goes to then US with his family for vacation, but he basically lives in the Philippines. Now we are planning to go to the US for our exams and probably migrate. Can he also file a IR-1/CR-1 spouse VISA for me? Pls help...

He will need proof of a domicile or intent to establish a domicile in the US. He will need an income, US based, that meets the poverty guidelines or a co-sponsor, any LPR or US citizen with sufficient income, US based, or sufficient assets in the US to meet the guidelines.

He will need to provide US tax returns so if he hasn't been filing he will need to take care of this.

How can you be filing for a K1 visa if you're already married? (Your profile says K1.) As far as a CR1 goes, no one knows. It could be pretty fast because of the situation over there, but it also might not be. How long ago did he file? Has he called them to see if you're eligible for an expedite because of the typhoon?

Thanks! He does not have income in the US. He is based in the Philippines. :-(

Then you need a joint sponsor. Manila accepts joint sponsors for CR1, which they do not for K1. I suggest finding a friend or relative in the USA (can be a citizen or resident) who makes above the poverty guidelines as stated in the I-864p, who can be the joint sponsor.

But you do not need the joint sponsor until the NVC stage. For the initial petition, which will be sent to the USCIS, you do not need this information.

The alternatives to a joint sponsor is using assets, of which you'll need $60000 for two people, or your husband moving to the USA and getting a job that meets the guidelines, which equates to a job that is about $11 per hour.
