AOS new last name but not new SSN yet

Hi all.

I wanted to take my husbands last name after we got married so we put my new last name on the AOS papers. But I couldn't legally change my last name at the Social security office yet cause they said I need to have my permanent resident card for that.

Last tuesday I originally had my Biometrics but they asked for an ID or something that states my new last name but I didn't have anything, so the manager said I should come back this week with my marriage certificate.

My marriage certificate doesn't say that I took the last name either, it just says my husbands name and mine.

Do you think it's still enough proof that I'm able to change my last name in future?? I wanted to have my EAD and permanent resident card already in the name I will change on my SSN in the future so I won't have to change the cards again once I got them.

I'm so nervous now, that we just did something real wrong.

Your marriage certificate allows you to use your husbands last name and it's normal that it has your maiden name on it.

The thing with social security is not correct.

It is normal. Some marriage certificates have only maiden name but it still serves as legal document change. So bring your passport, marriage certificate and app. Letter and you'll be able to do your biometrics. Don't worry about SSN yet. You'll be to able to change name on it when you have EAD/AP.

It is not where I breathe but where I love that I live.

Thank you!! What do you mean with the SSN?

I meant that the information they gave you (you can't change your last name on your social security card until you have your permanent resident card and EAD) is not correct. I went back after I got the card that was in my maiden name and a couple days later I received the new card with my married name on it. It's not a big deal, you can always go back and change it once you have the documents they want or go back now and argue with them ;)

The problem was that it took so long till we got our marriage certificate that i basically filed for the AOS and went back to the Social security Office then and wasnt on my K1-Visa status anymore and the system didnt let him change anything cause i dont have a current immigration status he could put in.

You don't "legally change your last name" at the social security office. You change it by getting married. It doesn't matter if the marriage certificate only has your maiden name. It is still the only legal proof of your name change that you need. Everything else is just updating various agencies of your new name. You can start using your new married name legally from the day you get married.

A photo ID with your maiden name + marriage certificate (even if it has only your maiden name on it) = proof of your new married name.
