Skimmed through your rant and wow... You knowingly broke the law for 5 years and now that you're busted you're blaming the system? Yes, it is flawed but had you followed it like everyone else you wouldn't be in this situation right now. I don't mean to sound uncaring but you did bring this on yourself.

I'm guessing she's all over the web looking for support.

She probably should be looking for a lawyer instead of sympathy. She needs to see what can be done, if anything, to rectify the situation. It certainly won't be a quick process.

I guess I'm in the frame of mind I'm in because I believe there are a lot of things unfair about the system. I personally believe our present immigration system is very broken. There's way to much cumbersome, repetitive paperwork required. The information infrastructure is archaic. Much of immigration law is written by immigrant category, which seems like a common sense thing until you realize that when new laws are written the brushstrokes don't always cover all the places they should.

I'm very concerned about new immigration laws that will surely pass during the next congress. I'm concerned that these laws should benefit families and not just migrant workers or EWI's.

I guess I'm thinking that if we, as those who brought their spouses over 'by the book', if we have our vision so narrow that we immediately say 'throw the book' at someone who didn't do things the way we did - well then we might miss the opportunity to have any new laws help us out as well.

More to this story than meets the eye.

Her husband should be entitled to a deportation hearing. They should be given a chance to file I-130/I-485 to stay his deportation, unless of course they were already given a hearing date in the past, ignored it and chose to just "fly under the radar".

Something is seriously wrong with the above statements. They don't jive with the statement that the only illegal activity was an "overstay" of the visa.

I agree Jane. I actually think she had him in a safe house. If you read her post then listen to the video, you might be able to see it.

I agree with you about the present system. We should all look at ways to improve the current structure. More than ever we are connected in todays world. As a person who loves people of all cultures, I find the future exciting. I just think this lady rubbed a lot of people the wrong way with her comments. I find her choice of words strange for such a diverse and international forum. Maybe she will step up to the plate and enlighten us...but somehow I doubt it.

Yeah.... Deportation always equals Mexican, doesn't it? *sigh*

Canadians get deported, Israelis get deported, Brits get deported, Czechs get deported. Why the emphasis on your spouse being NON-HISPANIC?

It's your own fault anyway... you've had 5 years and still didn't file the paperwork. No sympathy from me.

I read through the thread and noticed that many were outraged at the O/P's comment about "Non-Hispanic" being deported as if it insinuate that whites shouldn't be deported.

Whether the O/P is a troll or not...I believe the O/P's comment derived from the Elvira Arellano case in which an illegal alien Mexican woman that has standing deportation orders since 2003 is holed up in a church and ICE is reluctant to carry out the deportation due to political repercussions. This case does give the impression that Hispanics that become a "cause celebre" are somehow immune from deportation after breaking numerous laws. Even though this is an old story...she (Arellano) still hasn't been deported. Does anyone see the irony in what the O/P is trying to convey?

BTW I don't believe the O/P has a leg to stand on. While I may sympathize...there are things they should have done long ago to rectify their situation, but didn't. They pretty much made their bed they have to sleep in.

First of all want to let you folks know the Non-Hispanic comment is SARCASM. A local news station was notified about our situation and when they talked to me they were on the verge of hanging up until they found out we were not hispanic. That is a sad fact of society since 9/11. We have become negative against certain racial groups. My personal belief is I am extremly lucky to have been fated by God to have been born in the US and I don't have any arrogance with regard to my stroke of luck. It certainly was not up to me or in my control where I was born. This is not my first marriage and my kids are of hispanic desent.

What happened in this case prior to our meeting was very well meaning friends of the team he was playing for filed a form with then INS which had to do with tourism and not employement. At the time he did not speak or write English. Forms were filed on his behalf without the proper fee's, signatures etc. I am sure none of this was malicious. For those who know and understand what happens when you accumulate over a year out of status it ends up being a 10 year bar to re-entry. There is no going back and filing the correct form now.

Coulda, shoulda, woulda...is marx-nix here. We shoudn't have met, fallen in love or gotten married and we did. We got married knowing that there would not be an immigration benefit but we were on love. We thought he would go back when he was given voluntary departure and we did not have the will to leave each other for an unknown period of time. At the time I had a school age child to support so taking off to follow love in Belarus was hardly an option at that time. Love does not always conquer all.

According to our immigration laws... you are required to have your romatic life in order and file certain paperwork PRIOR to falling in love and getting married. Its a what comes first the chicken or the egg. We unfortunately met and fell in love without checking with Uncle Sam as most Americans do. On our attorneys advice and we got second opinions we waited it out hoping for a law change. There were a couple things in the hopper but since 9/11 no positive immigration legislation has passed. Which is why I use SARCASM in discussing hispanic issue. Saudi's enter through Canada, fly into World Trade Center and we as a Nation are "fed up" with hispanics.... makes perfect sense to me !

With regard to the "HIT AND RUN POST"... i have been a little busy with my situation given the Homeland Security Team wouldn't tell me where my husband was for 3 days. They have him in custody in Lumpkin Georgia 10 hours drive time from our home. Didn't have a laptop to check in on what you folks might reply prior to this. I am not drumming up sympathy... perhaps someone can learn something from this. As one of you pointed out NOT EVERYONE IS FOCUSED ON IMMIGRATION PAPERWORK while they are in the middle of a courtships.

At this point we can file the I130 and although it should provide a Visa he is barred from re-entry for 10 years so it will do us little good. What we did for 5 years was wait because in our situation that was really all we could do.

Not sure I agree with that statement. My husband and I were in love with each other a year before we decided to file immigration paperwork. We knew what we were getting into since he's a foreigner. We researched and educated ourselves on what is required for us to be together. It's a matter of realizing that "hey, my SO is a foreign national, I love this person so I better see what's needed and required for us to have a life together here in the US" kind of thing. Just my opinion.

You're right....In 5 years they couldn't find this website or one like it (like USCIS maybe). Funny how she managed to find it only 11 days after he gets picked up. It's going to be a sad Christmas for her, but '####### were you thinking' seems such an understatement.

I have actually had my eye on this website for several years. Our Attorneys advice since he was subject to the 10 year bar and nothing but a change in legislation would help our case was don't commit any felonies and make things worse. And simply wait hoping for a law change. His passport was expired so we couldn't apply for Canadian citizenship. Love is not logical..
