Ok, devil's advocate here.....

P1, H1B, whatever........say there's no more to this story than the simple fact they didn't know how to fill out the right papers.....

Play nice here people.....

Should someone be deported for that?

Isn't that the rule? You overstay your visa and don't fulfill the requirement to stay, don't you risk deportation? I'm sure both of them knew the consequences...they had to. She certainly knows what Homeland Security is now. She has gotten smart on the process real quick.

P1, H1B, whatever........say there's no more to this story than the simple fact they didn't know how to fill out the right papers.....

Isn't that the rule? You overstay your visa and don't fulfill the requirement to stay, don't you risk deportation? I'm sure both of them knew the consequences...they had to. She certainly knows what Homeland Security is now. She has gotten smart on the process real quick.

I guess what I mean is...does the punishment fit the crime?

I'm asking you to think about this rather broadly here. And I'm not defending the behavior. I'm just wondering aloud about this....

I think the punishment fits the crime, sending the immigration violator home sounds fair, at least they are not being locked up in an American prison for the 10 years of the bar period.

I don't know if you call it a punishment. It's merely a rule. Do they enforce this rule all the time? I'm sure it would be real hard to round up every illegal alien in this country...it's not plausible. Does that mean you don't deport anyone then? I fail to see the injustice here. If there was some sort of red tape that prevented him getting adjusted or something they had done to keep him from filing for adjustment, then that's one thing...this is a simple case of neither of them doing a thing for five years and the government finally catching up with them.

I'm not looking for a particular answer I guess. Maybe a philosophic discussion?

OK....is there anybody who can say they've not encountered many Americans who still truly believe that all an immigrant has to do is marry a USC and that's all there is to it?

Now before you shoot me down, yes I realize it should occur to the parties involved that there's a whole lot more to it than that. And I believe that too myself.

All I'm wondering is....does that kind of....um....stupidity....qualify for a deportation?

She probably should be looking for a lawyer instead of sympathy. She needs to see what can be done, if anything, to rectify the situation. It certainly won't be a quick process.

More to this story than meets the eye.

Her husband should be entitled to a deportation hearing. They should be given a chance to file I-130/I-485 to stay his deportation, unless of course they were already given a hearing date in the past, ignored it and chose to just "fly under the radar".

"In answer to the question why did you NOT leave when Uncle Sam told US to.."

"The government forced me to do since there was no other way to live in the country

with my spouse without "living on the lamb".

Something is seriously wrong with the above statements. They don't jive with the statement that the only illegal activity was an "overstay" of the visa.

Is it harsh? Yes, honestly. Given as he was married to a USC, it would have been nice if he were given the opportunity to apply for AOS (which he could have done any time up to the point when he was deported) before they kicked him out of the USA, a kind of "AOS now or else". However, the law is the law, and its generally not lenient.

Yes truly a Hit and Run, original Post time 10:16 last night, and OP's profile shows last visit as 10:15 last night, never bothered to stick around to see the aftermath.

Like dropping a bomb and not returning to see what damage was caused.
