this has to be a troll...just yesterday someone here was referring to a friend citing God's law as reason to not break up a family, and now this?

It maybe but it is being reported on an abc affiliate as I did a google on the dudes name.

yep, just googled it after reading your response....I retract my statement! I initially thought 'this has to be a wind-up' but I was apparantly wrong

But Nancy, HOW DARE YOU make the distinction of 'non-Hispanic/white'???????? You ought to be ashamed of yourself! I'm sorry for your situation and I realize you're clutching at straws now.....but for you to come to an immigration website and spew racist comments like that...as if being white/non-Hispanic means you're somehow better than those who are non-white or Hispanic. That is really quite nasty

Him being white and you being a soldier doesn't give you an automatic pass for not following the law. And as someone said....you found this site just fine now that you're putting the word out....you coulda found it years ago as well.

Again, I feel bad for your situation and hope that you two resolve it....but please stop with the racist comments

I am reading this hot topic with a very big interest.

And I really don't know what to say.

But at least I can say to nancyk that we are all here on VJ to chear eachother up and share our legal visajourney in this long waiting time.

This long journey makes us as wrecks and why shouldn't you feel this too for 5 years ago?

there are so many things wrong with this story that its hard to know where to begin...

for all those saying that its only hispanics that are illegal immigrants, this should wake them up... it should not make any difference where/what ethnicity the illegal immigrant is... they ALL are breaking the law...

and while she states that she doesnt advocate for lawlessness... she knew they had to "fly under the radar", meaning she knew dang well that his being here beyond his visa was against the law... why is it ok in her mind to break one law, but not the other? (and dont throw traffic violations in here, you dont get deported over speeding)

there is MUCH help out there to get thru the visa process... a ton of it provided by the USCIS itself... does it take time? yep... does it take money? yep... but as much time and money as this 10 yr ban is going to cost? i bet not... just because they didnt want to figure out the forms or pay the fees does not make it ok to just not file for permanent residency... and, in fact, the USCIS has had to expend money and time to enforce the law on this illegal immigrant, which takes away time and money from helping those USCs who are doing things the right way...

and dont bring God into this... #1) separation of church and state... God (or whichever diety or lack of diety is believed by the other USCs) has nothing to do with protecting your husband while he breaks the laws of this land... and i am thankful for that, because i dont want laws in this country that are based on someone elses religious beliefs... while there is the chance it might be the beliefs that i share, it could just as well be ones that i dont #2) in the bible, we are told to give unto ceasar what is ceasars... in other words, follow the laws of the land in which you live... God/Christ did not support lawlessness like not paying taxes, etc... why would anyone think it would be different for the laws of the land regarding immigration? this couple KNEW before they took their vows before God that they should file papers to enable him to stay legally... God (or anyone else for that matter) didnt force them to neglect that

am i grateful that there are those out there that serve to protect our country? yep... you betcha... but does it mean they can be above the law? nope... sure doesnt... so dont rely on that either...

what are the details that are not shared here? what more could be learned should this go to court and be a matter of complete and open public record?

does it suck that this woman and her child are now separated from the most important man in their lives? yep, sure does... BUT, every day of that 5 yrs of marriage, they knew the chance they were taking (the child prob didnt, but sure as heck the woman and her hubby did)... they gambled and lost... they knew the stakes... they are adults and should be responsible for their actions... so dont cry that you couldnt win everyday for the rest of your lives... thats not an inalienable right ("We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men." - Thomas Jefferson)... the govt was instituted to try to make that happen for everyone who is a citizen here, not just those who think they dont have to mess with the red tape

I think Nancy may be guilty of irresponsibilty to her husband insofar as it relates to making certain his status was adjusted. I'm not certain her comments are racist - I think she might have been trying to make a point about how the system works and she did it badly.

One can adjust status from an H1B upon marriage to a US citizen.

This story is hogwash. Some significant detail is missing... :yes:

On the nail, Reinhard.

Even on TN-1 (which is not supposed to be dual-intent), it's feasible (for holder married to USC) though more difficult than from H1-b.

There are thousands of H1-b's who've done successful AOS--many WITHOUT USC marriage (smaller number of TN-1's, but not 0--only taking the number who did AOS, not consular).

Plus H1-b is for professional (science, management, technology) jobs--not sports/entertainment.

The story almost sounds like it was lifted cut-paste from The Onion, except that it's too dry.

I'm still trying to figure this out....why does she say DHS lost her husband? Did they come to her house AFTER they apprehended him or was she hiding him and they were looking for him?

She refers to 'Monday' in her post here and in the video.....

I'm confused...

I think Nancy may be guilty of irresponsibilty to her husband insofar as it relates to making certain his status was adjusted. I'm not certain her comments are racist - I think she might have been trying to make a point about how the system works and she did it badly.

Yeah Becs, I too thought she might be clutching at straws, but there really is no need to throw ppl under the bus like that.....my WHITE NON HISPANIC husband is getting deported! the nerve! Especially to a forum such as ours where we have members from all over the world and chances are there are non-white & hispanic ppl here...so yeah, just sh!t on them, right? Cos Nancy has a problem so ** eveyone else.

Not to mention it feeds into the negative stereotype of white ppl feeling entitled above everyone else...and I think that sucks.

Nancy is really in a mess right now...but for the life of me I cannot figure out how someone just leaves the status unadjusted for 5 years. When D and I got engaged, we both thought 'ok we get married then you're a citizen' <---showing how ignorant we were at the time.....yet we still found vj to check out the process Of course, these comments are nothing more than Monday morning quarterbacking, but I am simply amazed. There is no justification such as 'other than the overstay we didn't break any other laws' Since when is it ok to be a selectively law-abiding citizen? She admits...as keltic pointed out - that she was flying under the radar...so to me that doesn't sound like someone who unknowingly filed the wrong forms in error all the while thinking she was doing everything right.

And to come here to garner support when everyone of us here is or has faced a long separation from our loved ones because we want to do things the RIGHT way? Why us? Why rally us when we're taking responsibility for our situations and following the letter of the law? We're supposed to jump on the bandwagon cos we're in int'l relationships too? No, maam.

Bottom line is: we can all blame everyone else, but at the end of the day, we're all adults and need to take responsibility for our actions and our inactions. I do hope Nancy and her family can resolve this issue with DHS, but the biggest tragedy of it all is that they are in this mess which could have been easily avoided.

Alan, that sounds like a good reason to be suspicious but in fact it isn't. That's exactly the charge which can be leveled at a USC if their spouse is without status. Sounds over the top I know but it's true nonetheless. Why do you think I'm so worried about my husband not having his greencard yet? It's this reason plus a myriad of others.

I understand Lisa. I can't google anything else on him or her other than what's already been posted.

I'm hoping that what Nancy meant was deportation could happen to anybody. I'm hoping the comment was not racist. But she's the one who typed it so who knows.

We are talking about an H1B here not some guy that came to pick Strawberries in Plant City. If one qualifies for an H1B one's gotta have the brains to figure out how to adjust status with the USCIS. It's bureaucratic, sure, but rocket science it is not. :no:
