OP, I think immigration wise, you have no say in anything anymore. But you can do a lot through the military to get him into trouble. If you have proof, that he is sleeping around, you can report him. Adultery is a serious offense under Military law.

I would start by contacting his superior officer and just explain your situation. I would hope they would help you get in touch with legal office.

You can approach this in different ways: report him with the goal to make his life hell and possibly have him kicked out (which still wouldn't change his immigration status much) or you could try to get the most of the benefits you are entitled to: health insurance, benefits to shop at commissary and BX, entitlement to his SGLI in case something happened to him. You are not entitled to a cash out of his BAH. That is not how it works. If you are officially separated, you can claim child support and yes, they will take it out of his paycheck automatically.

WRONG. She is entitled to the differential between single BAH and dependent rate. UCMJ even states this. The soldier, when separated and doesn't have actual physical custody of the children, has to give the BAH for the children.....a soldier living alone has no right to dependent rate BAH. I've seen this many times and it is almost always understood that the BAH will sub for support til divorce is final while the soldier lives in the barracks.

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing
