IMBRA WAIVER same petitioner, same beneficiary

Timeline

Hello, anyone experienced similar situation?

I got an approved visa in 2012 but I had to leave after 5 days because my grandmother died and I just couldn't miss her funeral since she was the one who raised

me, everything happened too fast. When I left, she was already feeling bad, but nobody would tell she would die because of it, I went to US but I got the worries

anyway...i left but I knew things were not ok with her although I couldn't wait anymore.

Now we want to apply again, I am not sure if I need the waiver or not and how to prove all that I said. There is no way to have a death certificate for example, my

uncle wouldn't make it available to me, he is not very close to the family, however, it was him who took care of the paperwork and funeral.
