Hi im the petitioner and my passport expires in 2018 and I was planning to file in January I know that it has to be valid at least 5 years, can I still file and renew my passport by time of interview of my fiance, im naturalized citizen I never got copy of my certificate because it was lost or stolen LONG STORY all I have is my passport. also in my divorce decree is state that I can go back to my maiden name should I change my passport with my maiden name which I didn't want to because once I marry my fiance I will be changing my name again please help any advice is appreciated thank you...

You got to show that you is a US Citizen or LPR. It's your fiance passprt that needs to be current at the present time. Once you marry your fiance you can change it then. I thought that your passport had to be current if you traveling at least 6 or 8 months or more. Do you have a US Passport now? No need to change it because your name will change soon. If you never went back to using your maiden name don't bother at this point.

If you are filing for a K1 why did you put filed for K3?

Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship. I see it now it must be valid for 5 years so this 2013-2018 that's 5 years depending when you got it. Anybody can correct me if I am wrong.

I would think it meant validity of 5 years.

passport issued : xxx 2010

passport expired: xxx 2015

Even with this expiry date. The passport can still be used, it does not mean that 5 years FROM the date of filing.

Passport issued: xxx 2010

passport expired: xxx 2014

This can't be used because it's only 4 years

Hope that clears all doubt.

K1 (I-129F) petition filed in August 2013 (Approved Feb 20th 2014)
13th May 2014: AOS (I-485) & EAD/AP combo card
21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

I feel silly now I got it I got my passport in 2008 and it expires in 2018. Thank u so much for the info. Getting paper ready for honey and super nervous. ..
