Hi Vjyers,

My mom petitioned my sister under F2A category and NVC sent her a letter today about the $88 AOS fee.. My mom came here in the US about 5 months ago. As the petitioner of my mom before, my husband was the co sponsor. I fill out I864 and I864A for my husband. my question is, can my husband be my sister's co sponsor this time? Will my mom fill out the form i864 and i864a for my husband(son-in-law)? do my husband need to declare my mom is one of his dependents including my sister? Please enlighten me. Will appreciate your input. Thank you and Merry Christmas To all!!

no, your mom will fill out an i864 and your husband will file another i864 as joint sponsor and he needs to add your mom not as a dependent, but to include her in the household size, there is an item for those who he has sponsored and gotten a GC. both of you are responsible for your mom until she becomes a USC, so he has to make enough for your family, your mom and your sister

You have to check the poverty guidelines to know if your husband's income is sufficient.

To determine the number of household, count: husband, you (wife), any dependent child/ren, any other immigrant he sponsored before, your mother PLUS the intending immigrant (your sister).

Thanks for the responses. Actually it was my parents whom I petitioned this year, then my mom filed a petition for my sis a month after she arrived in the US. My dad is currently working for three months now but he doesn't meet the poverty guidelines. So my husband will be the joint sponsor to my sister. I have one more question though, can my husband submit the "promotional job offer" he got from his office last october rather than the usual employment letter? just wanna know if this will be acceptable since they are pretty much same as the employment letter. Thanks again.

No children. husband makes more than 60k, also stated in his promotional offer letter. Not sure though if that letter is as good as the actual employment letter.. thanks for the details.

If his 2012 ITR and W2 shows 60k+ income, that would be enough.

Employment letter and pay stubs will only be needed if he just started on the job.

He has been working for 5 years in the same company. He got promoted last October and raise around 60k. Before the raise, he makes over 50k.. So, I think the promotional offer letter will not work. His 2012 ITR shows the over 50k annual income since he has just got promoted couple months ago.

Your sister can bring another AOS package for the interview coz by that time they'll be looking for the 2013 ITR and W2.

Hi apple21,

I have a question about the Part 5 of I864 ( Sponsor's household size)

Should my husband(co sponsor) fill out the item #6: If you have sponsored any other persons on I864 or i864ez who are now lawful permanent residents. He fillled out i864a before when I petitioned my parents. I just want to make things clear bec I'm confused with items #5 and #6.. Thanks so much in advance

Hello, thank you! I have one more question though. So my mom is about to fill out the I-864 and she is currently unemployed and has never filed her taxes since she has been in the US for only 6 months. She worked for only 2-days on an assignment in a temp agency in Oct. And that's pretty much it. Is she gonna skip or leave it blank to the Part 6 Sponsor's Income and Employment of I-864? I appreciate your response. Thanks

Thanks. She worked 2 days for that temp assignment and was paid around $70.00. I will also have to make a copy of her paycheck and send it with the packet right? Also, My husband(co sponsor) and I are filing taxes jointly, do I need to fill out I864A? But I am not sponsoring my sister since I am currently not employed. I only thought of filling out the I864A bec of the Income Tax Return from the previous years when I was still working.

no, never leave blank, she will put $0 income if she never worked or the amount she received when she got paid
