Why not tell the truth. If she's been to the US, there's a record of it. If she hasn't been to the US, there is no record, so stick to the story.

Consistency is the name of the game with the USCIS, however, once identified that a "mistake" has been made, better to deal with it now than have to make up even more later, or worse, be denied indefinately.

This is so true. But unfortunately, she told me she came to the US illegally. So... URGH!!!! I have no clue on what to do.

Was there a record of her being in the US? Did she have an I-94 or A number or anything like that? Was she deported or did she just go home on her own?

Either way... somehow you're going to have to determine if she was caught in a lie or if she simply made a "mistake" with the interview questions. I would press that, saying that she somehow made a "mistake" with the questioning and would like to start over or something like that.

Lemme see if I understand this.

Your fiancee had been illegally in the US previously...and you never knew???

but if you did know....how did you answer the question regarding previous visits to the US on the I-129F???

If you lied, and she lied.....did you read the section about supplying false information and the penalties??

I dont think I would count on getting a visa...probably never, and be careful that if the govt decides to prosecute if you gave false information under oath.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Yep, Desert Fox is correct. This is the USCIS - not a bar that you are trying to enter using a false id or by giving the bouncer ten bucks! Don't lie about something as critical as having been to USA! I am afraid she is out of luck for many years but maybe you can find a lawyer and ask them what you can do or not. Good Luck

There may be two issues in play here. One is the issue of her admissability on the basis of her past history of trips to the USA.

Another issue may be the validity of the relationship - has your fiancee been open and truthful with you about herself, and knowing the truth about her do you accept it.

You are in a bind, as how you answer may impact one issue positively but the other negatively. Time to have a consultation with an immigration lawyer, preferably one who is familiar with the consulate, the consular officers, and can guide you in how to repond based on both the facts of the situation and how best to deal with the consular officers at that post.

Okay, my fiance went to the interview and stated that she never came into the US. Later on she said that she did. They called me up and asked if I was aware of her entry into the US which I denied. She's scheduled for a second interview. Any advice on what to do?

Like others have said, if she has entered illegally that will definitely seriously hinder your getting a visa. You have have have to be honest! I agree you might need to talk to a lawyer about this....

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

Thanks for the replies.

Basically, I didn't know she was here. I guess never mentioned it. I've got an appointment with a lawyer but I think they'll say the same that since she was here illegally and that the documents contained false information, the visa will be denied. Life sux monkey balls sometimes. And I know the truth is better. I guess I'm in a heap of trouble.

As far as you knew, you were truthful. I do not suspect you are in any trouble.
