applying for reentry permit while out of the country (coming back for biometrics appointment); "biometrics" is fingerprints, right?

Oh Boy...

First of all, thanks for replying, even though I think the tone here is getting a wee bit defensive. I don't have an attitude, really I don't; I am simply asking for some information from anybody who's been in a similar situation, rather than advice like "don't try to get around the rules."

Asia, thanks for your reply; could you please tell me what ROC is? My husband has been out of the country exactly 3 months tomorrow. He will come back before 6 months is up, no matter what.

There you go. Have him file for AP when he comes back before the 6 months are up. The bio appointment will be about 30 days after the AP is processed and you receive the NOA1. Look at is GC and see when it expires. If it is during his time at the new job, he will need to be able to file for removal of conditions (ROC) 90 days before the expiry date on the GC. Living outside the US will make it harder, but not impossible for him to ROC as the ROC is about a bona fide marriage and being a LPR. Filing for AP to maintain his LPR status will help when it comes time to file the ROC, but you might want to look at those requirements to see how to accomplish that with the new job being outside the US. Do not forget to file US taxes and maintaining a residence in the US will help with the ROC.

I am curious, as my husband has a 10-year GC and we aren't dealing with ROC (he started off with an IR-1 rather than a CR-1 visa as we had already been married 10 years) if AP is very similar to getting a Reentry Permit?

Thanks for the estimate that the bio appointment would be about 30 days after the NOA1 is sent; we are trying to estimate how long he will need to be here in order to file & do the bio appointment, so we can figure out when he ought to come (before 6 months is up, of course.)

No need to file AP since he has the green card. Good news he has the 10 year card to, makes you life much easier in what he wants to do. Now he just needs to return in time to file for the re-entry permit and stay long enough to do the biometrics. I wouldn't recommend him extending the work by filing another re-entry permit though. Too much time out of the country, even with a re-entry permit, can get him denied at the border. He needs to spend time living in country to maintain his legal permanent resident status.
