Can my husband travel with CR-1 visa same day as pick up

Guys,

My husband screwed up and didn't pick up the visa today so now he has to wait until Monday. My question is this- if he picks it up Monday morning from DHL, will he be able to use the visa the same day to travel to the US? Will he encounter any issues at POE? For some reason he keeps thinking he has to wait a day or two before he can use it. I plan on paying the green card fee before he lands in JFK.

Any problems with this? Urgently awaiting your responses.

The visa has already been issued, and I don't think it matters whether he flies the same day he collects it or not. The date of issue that is stamped in the visa is the date recorded at the embassy, not DHL. I think they give 6 months in which to travel to the US. Some persons have picked up the visa on the same day they plan to fly...although that is not a wise thing to do because there might be delays. Good luck.

Oct. 22, 2015: Travelled to my new home :) (In order to get IR-1 Green Card) Expiration date on IR-1/CR-1 Visa - Oct. 29, 2015

Nov 10, 2015: Received Social Security Card

Jan 4, 2016: LPR Green Card arrived.

After he has the visa in his hands he can travel at any time.


You will need the registration (A#) off his visa to pay the fee via ELIS. It doesn't need to be paid before he POE's but anytime within the first year. His A# is not something you should text or send over unsecured internet.

He can travel the same day he received it and take my advice and pay for the green card before port of entry..get it right the first time and follow the rules of the Embassy....Blessings.

He can leave the same day. My then fiance did and there were no issues. Just a hint, book direct through the airline via telephone. There is a timeframe usually 3 hours before departure. There are some significant savings. Good luck driving through NYC.

There is no rule that states the Green Card Production fee has to be paid before coming through a POE. Furthermore, that fee has nothing to do with the Embassy as the fee is paid to USCIS, not the State Department.

Ok Ryan. Whether USCIS, NVC , US Embassy, they all work together, I was just advising BethAnn, my husband just arrive here abs so I know what I am saying...ok...please read info below...questions and answers from the US Embassy through the Jamaica news paper...

Q: I recently visited the Embassy for an immigrant visa appointment, and the officer told me that I should remember to pay a new immigration fee before I travel to the United States. Is this different than the fee I paid when I began the application process?

A: Since February 1, 2013, US Citizenship and Immigration Services (USCIS) has required immigrants to pay a new US$165 fee. This fee covers some of the costs associated with processing immigrant visa packages and green cards. This fee is paid after the immigrant visa is issued, so it is not the same as your visa application fee.

The new USCIS fee is paid online using debit, credit or chequing account information. To begin the process, visit www.USCIS.gov/immigrantfee. If you do not have Internet access, another individual may make the payment for you.

Immigrant visa holders are encouraged to pay this fee before travelling to the United States. You will be allowed to enter the United States if you have not paid the fee, but your green card will not be issued until after the fee has been paid. Failure to pay the fee before travelling to the US could, therefore, cause delays in your green card processing. When the US Embassy returns your passport to you via DHL, you will receive an information sheet about the new fee.

The only immigrants who are not required to pay this fee are individuals who receive fiancé(e) visas, returning residents who have SB-1 visas, children who enter the United States under the Orphan or Hague adoption programmes, or Iraqi and Afghan special immigrants.

The Embassy staff in Kingston will answer questions you may have regarding the US Mission, including consular law, regulations and/or practice. In order to respect privacy, staff will not answer questions about specific visa applications. The embassy employs a visa appointment system, so it is only necessary for visa applicants to arrive 15 minutes before their scheduled appointment.

Incorrect; USCIS falls under the purview US Department of Homeland Security, the NVC and US Embassy falls under the purview of the US Department of State. Two entirely different US Government agencies with different missions.

What Ryan is saying is that it doesn't actually *matter* if the $165 is paid before POE - they'd clearly prefer that from their process steps - but it's not a legal requirement and doesn't prevent the person from POEing on their immigrant visa. It'll just delay the production of the green card.

If the OP wants to get the passport in his hand then immediately hop on a plane, and hasn't had the opportunity to pay the $165 before he does so, it won't prevent him entering the USA.

Failure to Pay

You will not receive a Permanent Resident Card (Green Card) until you pay the required US$165 USCIS Immigrant Fee. Failure to pay the USCIS Immigrant Fee does not affect your lawful permanent resident status, but it does affect when USCIS will be able to issue you a Green Card. You should pay the USCIS Immigrant Fee after you receive your immigrant visa package from the Department of State and before you depart for the United States.

Note the SHOULD not MUST.
