Baby on the way, will this cost process to stop

cray5ol.gifHi VJ family I really need ur response and help, I visited my wife several weeks ago in Jamaica, spent a few weeks I found out today she is now pregnant, which will be my first child. AM a May filers our case was transfer to NSC on dec 4. I feel strongly it will soon b approved but am very worried now as a friend told me the pregnance will stop the process or reject it until the baby is born then I wound have to file over??????? how true is this plz I need ur help

Huh? No it won't. Your wife will be approved/denied regardless of the baby, based on the merits of the application you sent in.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

as far as i know, the case will continue as normal.

and after the child is born u can get a CRBA done.

she got pregnant next month when I was in JA, and I filed from MAY, I know it wont affect the approval but after it gets approved and it come to the time for her to do her medical??? someone told me today they will dump every and tell me to refile after the baby is born, am confuse

It depends on the circumstances of when the child is due and if the visa is already issued.

If you don't meet the residency requirements of CRBA, no US passport for the baby, hence you will have to file a separate i-130 for the child.

I don't see why a pregnancy should affect your CR1 application.

Most likely if you can file for your wife you should be able to apply for crba.. Don't worry. You have been given your options.. If your wife gets her visa before she gives birth and she can still travel. Then she can give birth there.. If she gives birth before the visa comes then CRBA is the best way.. Goodluck. I am praying that she can travel before she gives birth

1/ if ur wife gets her visa before the delivery, she can give birth in America.

2/ if ur wife doesnt get her visa in time, she will give birth in Jamaica but thereafter, u can apply for CRBA.

3/ if for whatever reason u dont qualify for CRBA, u will have to do the whole i130 process for the child.

My wife was pregnant during our application process. It won't stop the process, but the problem may be when it comes to medical. If she needs shots or more importantly a chest x-ray for the medical, that may be an issue. You'll have to research the chances/side effects for a chest xray while pregnant and decide for yourself if the risk is worth it.

It wont stop the process, that person don't know what

they are talking about, and if your husband is a USC

you can register the birth of baby at consulate cbra,

only way it would affect anything is if she receive visa

at say 8 mths into pregnancy the airlines will not allow

her to fly then until after birth.

Hey Guys! I just want to jump in here. He would like to know IF the process will be DELAYED because his wife is PREGNANT and as we all know SHE HAS to do MEDICAL. So will the MEDICAL delay the process ? Kindly explain that to him and to other persons who maybe in the same situation. Thanks.

to deal with the issue that medical might come before pregnancy or that she might have to fly during last months of pregnancy, just delay the process after your file reaches NVC. If you are proactive at NVC stage, they things get faster, if not just wait for them to send paper copies and that way things can be delayed accordingly.
