Wanting to live with my partner - Please help!!

Hi there...really hope I can get some help with my situation.

I'm a London based musician on a P3 Visa. I was in the USA between September-November and met an American lady who I am very involved with and would like to find a way that we can be together. I am due to go back to work in America in January but I'm having problems with my employer (posted a whole different topic about it!) and I'm scared that I will be sacked and therefore we wont be able to be together. So would filing for a K-1F Visa be the best option and how does that work with my current P3? Thank you for your thoughts!

P visas are generally believed to permit dual intent (http://www.americanlaw.com/dintent.html - final paragraph) so you would be able to pursue a fiancé visa at the same time you were present in the US in P status. Since a K-1 is a nonimmigrant visa anyway this is probably less important for you.

ok that's great, thanks for that info! Presumably if I was either sacked or I quit my employment I'd have to return to the UK until I managed to obtain a K-1F right? Is there any other type of Visa that you think might be better?

Timeline

K-1 visa holders aren't allowed to work in the USA.

However, K-1 visa holders are allowed to adjust status, obtaining a green card and work permit.

It takes time after the Adjustment of Status case is submitted into USCIS, before a work permit and green card are issued.

There's also an option to adjust status inside the USA after marriage whilst you are solely holding that P3 visa, so bear that in mind.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Hi again Darnell! Thank you for your thoughts....are you saying it would be better to keep hold of my P3 Visa and get married rather than apply for a K-1F?

...any other thoughts on this would be very much appreciated! :) Also my employer is not supportive of this relationship *at all* (that would be an understatement!) and is trying his hardest to stop us being together including telling me I need to make a choice between working or her...is that ok? Can he do that? He's also saying that if I have my place of residence where she lives that this would bring up a red flag with home security because I put in my Visa application that I would be staying at a different address on our time off and this can not be changed! Is this true?

Thank you so much in advance for your help as I really feel helpless :(

Your employer sounds like a real nice guy ;) - so I'd be inclined to get on the path that gets YOU what you want and eventually the ability to work for whoever you like in the USA.

ok - after reading your two topics, here's some other advice.

Take the P3 visa job, and have yer lass MOVE to the city where the employer wants you to be, for the duration of your visa. If romance blossoms and you two decide to make it permanent, get married towards the end of the P3 duration, in a state that allows same sex marriages, then file the big adjustment of status set/case.

All of this other moving you think you want to do, to keep the job, is silly. Have yer lass move to 'that city'.

Oh and on another note, stop letting your boss dictate your social life. Your employer only needs to know if you are single or married for your taxes, that is it. You do not have to ever discuss your social life outside of work with anyone at work.

Thanks a lot for that :) It's difficult when I have no idea what is ok and what isn't and my employer knows this and is throwing his weight around...
