hey visa journey forum,

my first post. Im getting married this summer in lebanon, she will be 16 at the time and i plan on immediately filling an application. is there an age limit for spouse?

The petitioning US citizen must be at least 18 and the foreign spouse must be of legal age in whatever jurisdiction they reside.

don't be judgmental my friend. Me and her have strong values and beliefs and are making a commitment to share our lives to together. I don't understand why its accepted for a 16 year old to have a boyfriend and be used sexually and given no rights of a spouse, then most break up and she suffers thru heartbreak. The world is ok with a guy that doesn't want to commit, the jerks that abuse, BUT low and behold you choose to commit to the same girl, give her rights of a wife over her husband, give her stability, and share ever lasting trust IT BECOMES UNACCEPTABLE OR FROUND UPON. think which you would rather for your teenage daughters on day.

I'm with you. I've been with my husband since I was 15 and now I'm 4 days shy of 24. That being said, please to be wary of what the immigration authorities will think. I'm having a hard time trying to find any solid instructions or laws regarding minimum age, but I always thought 18 would be the minimum as consummating a marriage with a 16 year old is illegal at a federal level in the US.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I'm American and got married the first time at 17. Knew a few girls who married at 16 and 17 as well, and this was in the early 2000s in the rural South.....not everyone wants to 'date' as they say. Anyway, look at the laws of the country you married in and unless there is a huge age gap in you two it will probably be OK.

Legally in the US, each state sets the laws for marriage and many allow marriage from 15 and up WITH PARENTAL CONSENT. Sex with a 16 year old is illegal at a federal level if over 18 but between man and wife even if one party is under 18 it is no worries.

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

as far as getting married in Lebanon - as long as it's legal to do, you are ok with the marriage bits.

as far as the IMMIGRATION bits - it depends on where the petitioner resides, the state laws there.

So, if the STATE allows for age 16 marriage, IMO it is SAFE to file the I-130 immediately after the marriage.

OTOH, if the STATE allows unencumbered marriage at age 17 or 18, I say DELAY filing the I-130 (but not delay getting married) until she reaches the age of majority in that STATE. IMO - that's rather safe.

Chasing a CR-1 visa isn't a fast thing, so regardless of when you get married, you still have to wait, she's not coming over the next weekend. I think if you plan this properly, knowing the calendar dates, you'll be ok and she'll be OK on interview day.
