Hi everyone, first of all happy holidays to you all!!!

Secondly,

My husband and I filled for my AOS in November, in my maiden name (as per advice given by our lawyer)...Now I've spoken to USCIS on 3 different occasions, this last time was with a tier 2 immigration officer who told me that I should've filled with my married name if that was the name I wanted to have...Well, nothing can be done to rewind time, so I asked how I can change it now - and he informed me the only way to change it is to file I-90, filing fee of $450...This is such a freaking scam, are you kidding me!??!

My question being, am I able to wait until naturalization in 2 years, and then change my name like a typical American citizen, or will I always need to file I-90 no matter how long I wait to change my name?

Hopefully someone else has come across this issue and can steer me in the LEAST expensive direction! I don't mind waiting a few years if it saves me $450.

You will receive your GC in your maiden name as that is the name you used to complete the documentation. You have two more chances to change your last name without paying for it. The next is when you file your ROC and after that is when/if you apply for USC. Jut complete the ROC forms using your married name and put your maiden name in the "other names used" section. If you feel you cannot live with the GC in your maiden name for the next 2 years or so, then yes, you will have to pay the $450 for a new GC. So wait and file for ROC in you MARRIED name.

The only place I know will be when applying for citizenship in three years. There is a place on the N-400 to change your name.

Dont think you will find this a common problem, hence not many answers to your question. Most use married name.

The lawyer was the scam.

All this just my opinion of course. :-)

Definitely a scam...So much frustration!!! I will do it on my ROC, and live with my maiden name until then! No big deal for me :)

If you have your interview you can tell to the interviewer that you want a different name. Happened to me because I put my maiden name into my middle name (as I dont have one) and then my married name. He said that is not possible and we can change it in the spot so we did (I put my new married name only). So he also told me if I had a problem with my name I could have change it , just tell him/her or explain him/her and they will do it.

If you have an interview, ask to change it then. Otherwise, use maiden name until you file for ROC and fill out ROC paperwork in married name.
