hey all,

I noticed from reading captin ewok above that it sound like I have the option of either filling out form I-765 or applying for a social security number for my fiance. She arrived here in the states on Dec. 14 and she is now legally my wife.

But Im really not sure what to do. Supposedly EAD takes around 90 days but the filing for a ssn should only take about two weeks. Sounds to good to be true. Could someone please enlighten me and tell me the correct path to take.

Thanks

You apply for both - they serve different purposes. There has been considerable discussion of this in this forum of late :)

Having an SSN does not inherently mean you can work - which I get the impression is what you think.

A person who enters on a K1 has until 2 weeks before their I94 expires to apply for a SSN or they can apply after they receive their EAD or AOS. Many people choose to apply while on the original I94 because a SSN is useful for many things (drivers license in some states, easier to open bank accounts, start building credit.)

Hope this helps, congrats on your marriage :)

Sandy

On a K-1 Can only work until the I-94 expires, then you will need EAD, SS Number is not authorization to work.

Also in most states, if a driving license is desired you will need EAD or Green card to apply.

Get the SS number now while you can, if you wait longer than 76 days from entry into the country, the you will have to wait untill you either have EAD card or Green Card to get the SS number.

Many people have a big problem adding spouse to or opening a bank account without a SS Number.

dieseldan,

It's not an either-or situation. You apply for neither, either, or both depending on what you might need them for.

Eventually she will need to have the SSN, no way to avoid that one for long.

Buttons,

No, a person does not necessarily need an EAD. Many do, but not all.
