My husband filed the I-130 in July for me, then due to very special circumstances, during my visit in the US I was in the obligation to remain here. My last week on the vwp, we found out about aos, so we decided to go to a lawyer to get some help. We just filed for aos yesterday, my vwp expires today.

I was wondering if that would be an issue for the uscis that we filed for I-130 separately overseas, then aos here? We do truly have special circumstances that forced us to make it this way and all the proofs for it. But I m worried I-130 and I-485 could be denied because it wasn't filed together?

Would that be an issue for them?
