Wedding situation with K1

Timeline

So my fiancée was excited to have some kind of ceremony for our wedding in Russia. We were planning on coming to the US first and getting legally married here to avoid any problems. Then returning to Russia and having a ceremony of her liking, I want whatever she wants.

I explained to her today though that after she comes here on the K1 that she can not leave the US until she has her AP (is that right?) and so it could be a few months before we can actually have the wedding in Russia. So this upset her and she doesn't like it. Then I told her we could maybe have a totally non legal ceremony in Russia before we come to the US but apparently they don't really have weddings like that.

Basically my question is, what are our options? What have you guys done? How long does it take for her to be able to travel back to Russia after her POE in US?

Timeline

The K-1 is for getting marry in the US. Tell your fiancée that you must get marry in the US first and then apply for an AOS. After filing the AOS, it will take 2-3 months to get AP.

She can leave anytime she wants. If she leaves without AP, she will spend a year in Russia until you can obtain another visa.

Your fiancée needs to understand that there are immigration rules. If she want what she wants, then there are immigration consequences to her choices.

She can wait 2-3 months for AP (after getting marry in the US) and go back to Russia to have a big formal wedding, or she can go back to Russia without AP and wait a year for another visa.

1. Enter the US, marry immediately (quickest is at the county courthouse) file for AOS and AP, wait about 2-3 months, then go back.

2. Marry here and then go back there get married, then you come home, she stays in Russia for about a year while you apply for the CR-1 visa for her.

3. Do neither?

What have you guys done?

Number one but didn't go back to Russia to get married again. Our families understood that international relationships and immigration forces the couple to do things differently. As long as we are happy was most important to our families.

How long does it take for her to be able to travel back to Russia after her POE in US?

2-3 months after you get married. Usually it takes about two days to obtain the marriage license and then about a week later to schedule the marriage with the county judge.

Above is Completely correct. I'm not trying to be rude but it seems his fiance is a bit on the spoiled side. It's great she wants the Russian ceremony. But you cannot marry in Russia legally and then go to the U.S. on a FIANCE visa and get married legally there. They probably should have gone with the K3.....

Exactly what Phil said or... have a family/friends gathering to celebrate you two getting married but don't actually get it legalized in Russia. Just a nice pleasant celebration. Gifts, money, cake, dancing, everything that is wedding kindred. My fiance and I plan to do this and no one is bitching about it.

Why is she against returning to Russia for the event, after 2-3 months? It isn't THAT long. You guys will be super busy because the process doesn't stop when you get issued a visa. You got AOS to do which includes gathering a lot of documents, etcetera, etcetera. Plus all the expensive fees involved. Waiting for a it makes it all the more sweeter and genuine. Hang in there!

You're having immigration's laws put their foot down on you: just put your foot down and tell her to calm down and wait. I'm sure she will understand if she loves you and you guys are meant to be together. good.gifsmile.png

In the end, all this will seem just an mere after-thought. After 4 years of being married, we are still as happy and excited as day one.

Again, you have to do things a little differently but your family and close friends will understand or come to understand and all will be forgotten.
