Hi guys,

Hope you could help us.

Year 2009 i was petitioned by my ex fiance. He abandoned me on 2010 after doing medical and never went for embassy interview, never seen each other since then.

Year 2011 my present fiance filed another k1 and did interview on march 2012. The CO said they need to return those 2 petitions since i have two active petitions.

March 2013, we got email from uscis that my latest petition with my present fiance already expired and may choose to file a new k1. So we filed a new petition (now 2nd petition with my present) last May 2013 and got approval this November and waiting for interview at the embassy on march 2014.

We are praying it will be okay this time.

But i still have questions like:

Does the first petition automatically terminated? I just know it was returned first by the embassy to uscis.

What do u think guys?

Your ex fiance has to call uscis and withdraw the petition or otherwise it's still active in their system

It could happen again if the first petition is not withdrawn

21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

i know someone who had the same problem as yours... she had 3 previous uncancelled petitions and got no contact with her ex-fiances.. she was approved and went to interview with her present fiance.. the presence of her fiance helped a lot according to her... so they got approved and now waiting for her visa to be issued

I had a similar case as yours. But as far as I knew and what I read, your previous petitions filed should be withdrawn by your petitioner because during the interview it will still appear on their system as "active". The USCIS will still approve petitions even if in the past your ex fiancee petitioned you, but you will have a problem during the interview. Ive read the same case as yours, and they got denied due to a multiple petition filed to the beneficiary. So in my case, I had to ask my ex fiance to withdraw the petition at the US Embassy to avoid problems in the future especially the interview stage. My ex fiance submitted a withdrawal letter to the US Embassy then after a month we got a response from them that our petition will automatically be revoked. But they have to send it back to the NVC, then to the USCIS. After a month, we got another letter from the USCIS, informing us that they already received the petition from the US Embassy for further review. I think based on my research it will take 6 months. I will be hoping that in February I will get the final revocation letter from them. I read a post today. You can check more details from my post.

There are several topics about this case on VJ. I'm afraid to drawn your hope but their K-1 visas application were denied because the previous petitions were not revoked. I hope you are the lucky one.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Oh wait. Let be informed that while the 2 old petitions were returned, only the second one from my present fiance got an email terminating the case and allowing us to file a new k1 which we did now. But the first petition by my ex, when i checked uscis website it still says the noa2 approval. Maybe they just forgot to update it?

Both petitions were returned to nvc as per CEAC website

Ceac is the website of the embassy informing applicant if we are ready to set appointment and do interview.

i have read a lot and i know that if u are the beneficiary u are not supposed to have another approved petition. and your ex-fiance is the only one who can withdraw it and i want to ask something ...

i am the beneficiary and my fiance had another petition which was approved 2 years ago but there wasnt any visa issued. when we applied we put a letter in which he stated he wants to withdrawn the previous petition? do u think we should do something else ? he made an infopass and the person there told him just to put such a letter in the documents and we will be fine. Any suggestions?

I am in that situation too. I disclosed the 2 priors in my I-129f petition. I got approval, fast and easy despite not withdrawing the second one.

But not wanting to take chances, I am now withdrawing the sedond one.

your old petition has to be canceled by your ex fiancé before any other petitions can be approved.

I filed a k-1 back in 2010 but my fiancé backed out and I called the uscis and they gave me an address

and told me to write a letter of cancelation withdrawing my petition so that's what I did. I am now married

to a different Filipina and filed a CR1 petition. I sent her my letter that I received from the uscis saying they

withdrew my previous petition back in 2010 so she could take it wit her to her interview.

I've never heard of that way before. Did you ever receive any letters confirming that the previous petition was withdrawn?
