I am a US permanent ( green card holder ) , the last couple weeks , I sent in the form I-130 to sponsor my spouse and a son 2 years old in Vietnam, then I received the rejection notice from USCIS , and It says : The application has not been fully completed , the following fields were not completed : relationship,

on form I-130 . Did I fill out wrong in the section A . Relationship 1. I am filling this petition for my : spouse and child ( I checked both spouse and child because I think i sponsor for a spouse and a child ) on the form , should I check spouse only ?

section C , 17 . list spouse and all children of your relatives : these should be me and my child ?

section D , other information :

1.if seperate petitions are also being submitted for other relatives , give names of each and relationship : should I fill in my child name here and relationship so USCIS can process together ?

thanks in advance

hi

no, you only check spouse, your son will be her derivative and then you list his name on C17. as long as you are only a LPR, your son will be your spouse's derivative.

if not you can do it the other way, file an i130 for each of them

those are your 2 options

if you file only 1 i130, then no, you aren't filing a separate petition for your child

The petition is for your wife. She is the principal beneficiary and the questions are about her. Your son is included in the petition as a derivative beneficiary.

A.1. I am filing this petition for my "SPOUSE". (DO NOT CHECK MORE THAN ONE. DO NOT CHECK "CHILD.")

C.17. Yes, you list yourself as the spouse of the beneficiary and you list your child.

D.1. Write "none." You are not filing separate petitions for your wife and son. There is only one petition for your wife. It just happens that your son is included in hers as a derivative beneficiary.

thanks for helping , one more question on I-130 :

C.21: If filing for your spouse , give last address at which you lived together

is it the address where my spouse lives in vietnam now , we have never lived together , I live in US and just traveled to Vietnam and lived with her for a month.

or leave this field blank? thanks advance

Thank you again

I filed I-130 and USCIS sent me the acceptance form I-797 , my case has been approved

The question is : what will I expect to do next , what will USCIS will send to me next and how long do I have to wait to receive ?

Thanks in advance

Acceptance is not the same as approved. Acceptance just means that you probably filled out the form correctly, paid the correct amount, and provided some kind of evidence. Now, unfortunately, you have to wait until you get your second notice of action which hopefully will state that your petition was approved. That will probably come within 8-10 months. After that, you can start on the NVC portion of the process. The instructions for that can be found here: http://www.visajourney.com/forums/topic/472916-nvc-filers-january-2014/ (Note, these instructions may change by the time you actually get to the NVC portion, so make sure that after you get your approval, that you check in the appropriately dated NVC thread.)
