i have read somewhere in this forum about applying work permit and instead of getting a 3 months validity, you can get a year validity. how will i apply for it? ive read that you have to use a certain code like © (9). what is it for? and how will i attached that? im confused to be honest. my questions are the following.

1. if i want to take advantage for one year work permit validity, what form will i fill up? is it the same form with the regulard EAD ?

2. the code © (9), how will i use it? do i have to download a certain papers to attached to the regular ead form? or theres another form to fill up?

please help. thank you.

hi

the work permit is the EAD that you file with the i485 when you adjusting status in the US

where did you get that it was valid for 3 months? maybe you misunderstood or got confused that the work permit can take up to 90 days until you receive it

the validity is for one year, but it is really valid until you have your interview. the work permit is not valid once you have your interview

I believe they are speaking of applying for an EAD before AOS, in which case you get an EAD that expires when your I-94 does. I guess that is where they get the 3 months thing from, although by the time you get the EAD, it would be expired already or have very little time left on it, so it is not really valid for 3 months. The category for that one is (a )(6 ).

OP, you fill out the I-765 and mail it in with your I-485. You should also go ahead and fill out the I-131 for AP. The fees for the EAD and AP are waived when filed with a pending I-485. The category used on the I-765 when filing with the pending I-485 is (c )(9 ). The EAD will have an expiration date of 1 year from when it is approved.
