Hello,

My parents have green cards, and came to US under IR-5 as direct relative of US citizen. I have filed Affidavit of Support (i-864) with NVC and my previous income had qualified me as a sponsor for both parents at the time of the application.

I have recently lost a job and am planning to starting my own business in the next six month, so don't expect any income for probably next year or so. I' am trying to figure out what do I need to do as a sponsor of record on i-864, as I' am not longer able to support them financially. I used to pay for their health insurance and housing, but since I lost the job I wont be able to pay for it any longer.

Can anyone advise on what do I need to so as a sponsor with immigration in these circumstances ? and if there are any options to get support from the government programs before I get back on track with my income ?

hi

you don't do anything with immigration. as a USC you can request government aid benefits.

check and see if you qualify for any of them.

the sponsoring them is only for means tested benefits, requesting for government aid, they have to get their own jobs and work here.

If you have no income currently and your parents take means tested benefits the government can come after your future income to collect the money with interest. Losing your jo does not end your obligation.

This will not be over quickly. You will not enjoy this.

Ok, I understand. So, unless they find a job themselves I will be on the hook to pay for all the benefits, even if they get the means tested benefits.

The only thing I really want them to have is health insurance. So you are saying if I will let them apply for MassHealth, then the government can tell me to pay back the amount of received benefits + interest in the future if they find out ?

Do you know who usually tracks this ? and what is the chance I would have to pay it back ? how does the process work in general ?

If your parents get MassHealth, then you as the I-864 sponsor will be responsible for repaying the benefits.

Couldn't begin to tell you how the government finds out. Don't know the chances. How lucky do you feel?

Your questions are impossible to answer. How does one get away with Medicaid fraud?

You don't have to tell USCIS anything.

But your parents can not apply for government help. The only exception would be WIC, but I don't suppose your parents qualify for that.

You as a USC can.

As long as you have a way to support yourself and your parents (or they support themselves) without government assistance, you're fine. You are not required to update anything with USCIS.

Like many uninsured Americans, your parents may have to go without health insurance.

If they end up in the ER, they will qualify for Emergency Medicaid. Emergency Medicaid is not a means tested benefit. You would not be asked to reimburse the government if your parents receives Emergency Medicaid

I have read about Medicaid emergency benefits and it states that only the following are eligible:

1. children under age 19
2. pregnant women
3. a disabled adult
4. a parent of a child under age 19
and my parents don't fall to any of those categories. Can they apply for something like free care in a particular hospital or facility ?

My LPR brother who is 52 went to the ER. He got Emergency Medicaid.

You can always negotiate your bill with the hospital. They may let you pay in installments or/and forgive part of the bill. My family lived without insurance (even for the kids until they became USCs) for several years. Thank goodness we never needed ER. You just have to hope for the best in a situation like that.
