Hi fellow board-mates,

My K-1 visa application was approved and upon entering the country a while ago, my then-fiance and I got married.

I'm now in the process of filing my AOS application - and am stuck with 1 part of the form I-864, Affidavit of Support. The last I checked, I'm using the latest - and only accepted - version (Revised 01/15/06). I'm helping my husband figure how to fill it out. Here's the sectionI need help on:

(Part 1, Basis for Filing Affidavit of Support) - There are boxes 'a' to 'f'.

'a' states that "if you are the petitioner who is filing or who has already filed Form I-130, Petition for Alien Relative...."

'b' states that "if you are filing or have filed Form I-140, Immigrant Petition for Alien Worker, for your husband, wife..."

Which of the 2 does my husband check? My husband's filed neither - or at least I think.

He should mark box A, since he filed a K1 for you, and now you are married, he's filing for the immigration of a relative, you, his spouse.

Since your husband is not your employer, and you are not on an H1B work visa (I-140) you would not check B so I guess that eliminates that one so 'A' will be your choice.

See example I-864 in the example forms, it is older but is still usable as a reference.
