We messed up and answered differently during the interview and was denied the visa. We talked about what we were going to say but I guess she got nervous and forgot most of it. They asked when did your fiancee propose? She answered the day I got off the plane.dry.png So I am very disappointed that we have to it all again. They said I can refile the same petition again. That is what I plan to do. Because I was told that if I were to go the Cr-1 Route I would have to get married again, take all new pictures and get all new documents. My question is can i just file the same petition over again? Is there a need for any new papers besides the police record and the martial status papers? Thanks everyone for reading. I am still here spending time with my fiancee while I still can. Next time i will let her go to the interview alone. I felt like if I just let her go alone she would be flying home with me in a week. I am very sad that he denied us the visa because of the living conditions she has to deal with over here. It's like going back in technolgy 100 years.

#######? You are already married?

I have the same experience.....they denied our k1 petition because of missing document but the we do the appeal then got approved in a month:)

so when you appeal you must prove that they were missing something? i think we are different because the co could not issue the visa because he was not 100% sure we were legitimate. I do no believe i am qualified for an appeal. if anyone thinks i can win the appeal please let me know

A missing document is not a big deal.

The OP has a much bigger problem; he and his fiancée rehearsed answers and then flubbed them at the interview. They also had a traditional marriage ceremony.

You have zero chances of winning an appeal when you and your fiancée gave different answers at the interview, your fiancée didn't know when you proposed, and having a traditional marriage ceremony.

You were advised in your last thread and in this one to go get marry. Your best chance at this point is to marry and file for the CR-1 spouse visa.

I have no choice but to file the k1 again. Don't have the time or money to get married, or else I would. I can't even visit her until she passes. This sucks.

How does refiling for the K-1 solve your problems of inconsistent answers and a traditional marriage ceremony?

You are not addressing the problems that caused the first denial.

There is an old saying (paraphrasing) - Don't expect a different result when you continue to do the same thing.

Thanks, so you personally believe I would get denied again if I refile the K1? I am willing to do it but probably gonna lose my job I've had for 5 years.

If you lose your job you won't be allowed to bring her to the US.

I believe that the reason for denial wasnt because of the traditional ceremony. So I'm gonna file again with more evidence. Then explain to them why we fumbled. And David and Zolla I know that's why i can't visit her often. Also why I can't get married.

They don't have to give you a reason. I was denied it too. Now she had give up on me. I had Bag her not to end my relationship with her. I try and try so Skype I lean on my knee. Now I know my fiancée not a good family to be with in a long time forever. If your fiancée will make a commitment together mine is not so good. This you can try spouse visa.
