Hey guys .. I need some help.. Me and my fiancé did a ( traditional marriage ) in July 2013. But we did not register anything or get a marriage certificate. And I included the the traditional marriage pictures as ongoing relationship (evidence).... Now I am worried that they may deny us a k1 visa .. !!!!Saying that we are married aready !! !!..I've read some posts about traditional marriages and some don't look good!!!. But traditional marriage in Uganda is not legal according to marriage law in Uganda.... I mean we had no any other option rather than the k1 visa.. What should we do? Any one with the same or similar situation??

Alas, you are 'too married' to receive a K-1 visa on interview day,

and 'not enough married' to file the I-130, chasing after a CR-1 visa.

Sorry.

Here's hoping someone will come along and suggest a fix for you.

I've been thinking about that, but the problem is USCIS is soon sending my file to NVC .. Most likely this week... I am totally confused ..

Not going to work when USCIS already has the evidence.

Canceling the petition does not mean USCIS throws out the evidence it already has.

The new petition would be matched up with the withdrawn petition. When USCIS or the US Embassy figures out that the traditional marriage evidence was ommitted from the new filing, it will raise a red flag for fraud.

Withdrawing and refilling without the traditional marriage evidence makes things worse rather than help.

About the only sure path forward is to kill the K1 marry and file a CR1. You will most likely be denied a K1 for being considered married in your country ( that is what Lagos would say ) and not married enough to file a CR1 at the moment. There is a very small chance of a misrepresentation charge for filing as single when you are considered married by tradition in your country

This will not be over quickly. You will not enjoy this.

On going relationship is for interview stage? If you meant that you send it as evidence of meeting prior to filing then you might need to withdraw the petition and get married in legal court then file for CR-1. Sorry you have to go through this. If you have not send in the pictures but have it in hand for interview then you can omit those pictures and pick other pictures to proof on going relationship

21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

I included the pictures already ... I am going to take my chances because we may have an interview next month. If we fail then will have to go with CR1 ... Edited by Aus077

wait and see if they will deny or ask for more evidence that you qualify for K1 visa.. then try to obtain a document stating that you don't have any record of marriage... im not sure though if Uganda has that kind of document. because im from the Philippines and here we have CENOMAR (certificate of no marriage)

How about I cancel .. Go get married and refile would that help???

Do not cancel. You don't know if you will get a CO who understands that you are not legally married and issue the K-1 visa.

Wait.

Go and get marry and file for the CR-1 only after getting a K-1 denial for being "too married" for the K-1.
