Questions about divorce after 3 month of marriage

Hey guys!

I came to the US in the end of August 2013, we got married in the middle of Sept, 2 weeks ago I applied for a Green Card.

Unfortunately, my marriage doesn't work, we fight almost everyday, so I decided to get divorce and go back to my home country. The issue is that I spent all my money for GC application and now can't by a ticket home. Does my spouse have to pay for my ticket ? (he signed an Affidavit of Support when we filed my GC)

Also, will I be able to apply for K-1 successfully in future or my divorce will influent on it?

Your spouse does not have a legal obligation to buy your plane ticket home.

The affidavit of support becomes effective when you get a green card. Since you do not have a green card, the affidavit of support is not in effect. In fact, your spouse can withdraw it any time before you get a green card.

This failed marriage will not impact a subsequent K-1 application.

Contact your consulate... They will help you... However I might add, after all the time and stress, perhaps 3 weeks is a short time to decide to call it quits... Adjustment is difficult and sometimes you need time and understanding.

OP have you and your husband thought about going to marriage therapy? Your marriage is very young and both of you are going through a lot of changes right now, it could take up to a year to adjust. Going from single to being married is tough for some folks. Please, try therapy, it can give you both strategy to help with adjustment and how to cope with living with a person you may or may not know very well. The fact that your husband and you worked together to file the green card tells me you guys both think that the marriage might be worth saving. Good luck

You've gone through all the time and effort and expense to get this far... Building a marriage takes work, and it takes even more work when you started out seperated by so much distance - living together in person is very different from just talking to them... what was it that made you and your husband want to be together? Unless he's actually abusing you (which generally involves preventing you from filing for a green card, controlling your actions and/or physically harming you), it's awfully soon to call it quits. It's not just a cliche to say that fighting is the flipside of passion... if you didn't care about each other, you wouldn't be fighting so much. And maybe you can figure out how to find a middle ground if you have some help. I'd STRONGLY encourage you both to give counselling a try before you get a divorce and go home.

Sad , after the all the hardship it will end up like this.. Hope you guys can find a way to solve any problem you are facing now., it's too early. I think being away from your love one is hard, but to decide everything is over is harder, if you two are really serious.
