Please Help! My FIance's Father Has Passed

Timeline

I am looking for help, advice and guidance. My fiance arrived here on 12/2 on a K-1 Visa. Her father has passed unexpectedly and she needs to return to the Philippines for the funeral and family matters. Are there any special allowances that will permit her to do so and still return without having to go through the whole process again? She is very concerned about being able to return to the US but my feeling is she needs to be with her family at this difficult time and if I need to start the whole process again, then that is what I will have to do.

Does anyone have any information about a situation like this?

September 24, 2013 - Physical Passed

October 22, 2013 - Interview Date - Visa Approved

November 11, 2013 - Visa Received

December 2, 2013 - Arrived in the US

December 30, 2013 - Our Wedding Day

February 7, 2014 - AOS Filed

March 4,2014 - NOA Received for AOS

Timeline

Hi there you may be able to get them to expedite the I-131 for you. Go to the June 2013 AOS filers and look through there as I know there was one person who got their I-131 expedited as they needed to go back to their home country to take care of someone or something of that sort and had their I-131 expedited. If you search"June 2013 AOS Filers" you will be able to find the forum. Hope this helps.

This happened to my ex after she got here and we got married. We had to go to our congressman. They got the Advance Parole turned around in a day, They had to walk her through the processing at INS. We started at 9AM and she was on a plane by noon.

Emergency Advance Parole Documents

If you are experiencing an extremely urgent situation, you may visit your local office to request an emergency advance parole document. When visiting a local office to request emergency advance parole, you should bring the following items:

  • A completed and signed Form I-131, Application for Travel Document
  • The correct I-131 filing fee
  • Evidence to support the emergency request (e.g. medical documentation, death certificate)
  • Two passport-style photos.

Contact USCIS (maybe contact the local office near you) and arrange for emergency issuance of the Advanced Parole, they will give you the guidance to accomplish this.

If you have not married yet, it could be possible to get the K-1 reissued. You would need to still get married within the original 90 days of her entry though.

9 FAM 41.81 N6.3 Reissuance of K-1 Visa
(CT:VISA-1547; 09-27-2010)
If a K-1 visa, valid for a single entry and a 6-month period, has already been used for admission into the United States and the alien fiancé(e) has returned abroad prior to the marriage, the consular officer may issue a new K visa, provided that the period of validity does not exceed the 90th day after the date of initial admission of the alien on the original K visa, provided the alien fiancé(e) pays a new application processing fee, and provided also that the petitioner and beneficiary still intend and are free to marry. The alien’s return to the United States and marriage to the petitioner must take place within 90 days from the date of the original admission into the United States in K status.

Contact the embassy about it. You will need to pay the visa processing fee again.
