so im on a tourist visa in america and on my visa they put a stamp saying dec 23, does thatr mean i gotta leave before the 23rd? cuz i wanna leave on the 23rd. would that be ok? to my understanding if it says the 23rd of dec that means i can leave up until or on that very day?

You must leave on or before the 23rd, so you can leave that day if you wish.

Your allowed time in the US runs through Dec. 23. You are fine leaving on that day.

Did you show the CBP your return ticket or tell them that you will be leaving on Dec. 23rd? Could not have been a coincidence that the day you plan to leave is the same date written on your visa.

Although with holiday travellers and bad weather depending on where you are in the States do you want to risk not making it out on time and losing your visa privileges?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Although with holiday travellers and bad weather depending on where you are in the States do you want to risk not making it out on time and losing your visa privileges?

Weather related and airline delays are taken into account. There is no overstay if the delay beyond the authorized time is cause by weather or airline issues.

Does that also include missing the flight due to bad traffic 2 days before Chrimbo?

How to extend my Visa Waiver Program stay in the U.S. if there is an emergency that prevents me from leaving within my 90 days

I am visiting under the Visa Waiver Program, but I can't leave as scheduled due to an emergency. How do I extend my stay?

If an emergency prevents you - if admitted under the Visa Waiver Program (VWP) - from departing the United States within your period of authorized stay, the U.S. Citizenship and Immigration Service (USCIS) district director having jurisdiction over the place of your temporary stay may, at their discretion, grant a period of satisfactory departure not to exceed 30 days. If departure is accomplished during that period, you will be regarded as having satisfactorily accomplished the visit without overstaying the allotted time. Satisfactory departure is only granted for real emergencies, such as hospitalization, conditions that cause flights to be cancelled or delayed for more than 24 hours (i.e. weather, worker strikes, etc. etc.) Otherwise, people visiting under the VWP may not extend their period of stay beyond their initial 90 days.

If you are unable to go to a USCIS office to obtain satisfactory departure because your overstay is due to a weather-related emergency and you are staying close to the airport until boarding, we suggest you keep a copy of any evidence you have of the emergency situation in order to resolve any questions about the reason for your overstay the next time you come to the U.S. This could include cancelled tickets, a statement from an airline about flight cancellations, including newspaper or other reports of significant storms.

really? cuz i called the polish consulate in chicago and asked her that question and she said i gotta contact the american custom and border service and i tried but its a pain to try and reach them...

You can stay in the US until 11:59:59pm on December 23rd.

If you want to stay past December 23rd, you will have to apply for an extension of your visitor visa. This is done through an I-539, but I would not recommend the hassle and uncertainty. Especially not if you're a regular traveler to the US. http://www.uscis.gov/i-539

i did not show them the ticket i dont think, from what i can remember.....my return ticket was for august the 20th.....cause i got here in june and they allowed me to stay for 6 months...i was planning to go back in august but me and my fiance decided that we wanted me to stay longer....(btw cbp did know that i am travelling to stay with my fiance and he asked about the wedding and all and i said truthfully that we will do this the right way by applying for the k1), and the reason i wanna leave on the 23rd is because the ticket is for some reason the cheapest on that day....the ones on the 19th, 20th, 21th, 22th...they're all over a thousand dollars. so yeah......will i have problems?? i mean cirumstances may change, right?.....like, i was gonna return in august and thats what i told them but i was legally allowed to stay here for six months, so..
