I-134 Tax transcripts from prior year due to college

Interview was today - I will post a more detailed review after I get to actually sit and speak with him tonight. <3

We were told all is well and we are approved, but we need a cosponsor (which we kind of expected). As soon as we submit the cosponsor information they will start processing to issue the visa.

Just for anyone in a similar situation:

I make well over the guidelines set forth per even the I-864p this year and had sufficient documentation to prove it. However, last year I was far below due to being a full time student who was taking a part-time unpaid internship AND maintaining employment. I did submit a letter of explanation along with a copy of my diploma and college transcripts as supporting evidence that my insufficient income for the year 2012 was due to being a college student. I started a job in my field in early 2013 as a result of obtaining a degree. - This did not matter. Current year income making and exceeding even the 125% income guidelines was not considered acceptable for the I-134 when LAST year's income was below guidelines.

We do have a cosponsor lined up but the information from the IRS and Vital Records has not come in yet.

I just wanted to share this information and our experience for anyone in a similar situation who may have had insufficient income for the prior year due to being in college or any other reason even if they meet guidelines for the current year.

Thanks for sharing this because I had questions/concerns. I'm right at the 100% but over the 125% if adding my child support. I wasn't sure if I was supposed to add that but I was hoping since they ask if I'm wholly or partially financially responsible for my kids that there has to be some percentage they take off or add to since I share custody with my ex-husband. Who knows. My fiance's interview is scheduled for Jan. 10th in Kingston and I'm sending him with my stuff, but he will have the co-sponsor's everything as well if they require it. I personally would rather not have one if at all possible.

27-02-2014- 2nd Interview - APPROVED!!!

13-03-2014- Visa ISSUED

19-03-2014- Visa in-hand

30-04-2014 - POE Fort Lauderdale, FL

14-6-2014- Wedding (tentatively)

Oct. 17, 2014: Case # Assigned by NVC (Same day case was received, according to Julian # calculation)

Oct. 21, 2014: Received letter from NVC

Oct. 22, 2014: DS-261 completed and submitted to NVC

Oct. 31, 2014: Paid AOS invoice


Dec 08, 2014: Sent in IV & AoS packages

Dec 11, 2014: Package received by NVC

Dec 12, 2014: Received email from NVC acknowledging receipt. I assume this is our scan date

Dec 25, 2014: Paid IV bill

Dec 29, 2014: Funds deducted from bank account. DS-260 became available, and was completed

Dec 30, 2014: Submitted DS-260

Feb. 12, 2015: Case Complete with NO checklist! whoot, whoot!

Mar. 25, 2015: Received P4. Interview

April 29,2015: Completed medical examination

May 13, 2015: Interview Date APPROVED :dancing:

May 19, 2015: Received Package

Oct. 22, 2015: Travelled to my new home :) (In order to get IR-1 Green Card) Expiration date on IR-1/CR-1 Visa - Oct. 29, 2015

Nov 10, 2015: Received Social Security Card

Jan 4, 2016: LPR Green Card arrived.

I am so sorry that you did not get 100% approval. I am glad that you are able to find a co-sponsor and then you will be together.

I would like to state to ALL in the JAMAICAN EMBASSY, they will look at previous years income only to meet the income guidelines, they do not care about current income. If your income does not meet, you will need a co-sponsor. In addition, they do not consider child support or unemployment benefits as income, they consider that to be inconsistent income. JA embassy only looks at 125% income guidelines, so please use the I-864p to determine your income from last year.

If you need a co-sponsor, or question that you need one, please just have one ready or be subject to 221g.

Thank you all for your kind words. Due to my age most of the people I know were in the same position as I in that they graduated last year or are working small jobs until they can find an applicable career for their degree. The problem for me was finding someone who is even elligible lol.

Now we are hoping the IRS & vital records provides the needed information on a timely basis.

Child support and listing your children as partial dependants probably won't be enough to put you over your guidelines so, if possible, I would start preparing a cosponsor as soon as possible. Each Embassy seems to view things very differently but the income guidelines in Jamaica are pretty strict.

We have our whole lives ahead of us together so the wait is just a small blip compared to the time we will be able to spend together. At the end of the day as long as I know we can be together after the wait I am happy. ???

Thank you, I truly appreciate this. We have our co-sponsor docs ready. She only has 2 previous years of tax returns because prior to that her husband was on there and we don't wanna bring him into this, but she's been on her job for over 20 yrs so I hope 2 years is enough. I have my last 4 years prepared though. I hope there's no 221g in our future just a happy approval.

Current year income making and exceeding even the 125% income guidelines was not considered acceptable for the I-134 when LAST year's income was below guidelines.

The totality of the I-134 supporting documents are what is adjudicated on interview day.

You missed out on prior year tax data, and the IV unit 'dinged' you for it.

To anyone else reading this - this is normal behavior by all IV Units worldwide, given this exact situation.

This stuff can be overcome on interview day if (pick 1) the petitioner either:

1. shows adequate assets or

2. submits the co-sponser/joint-sponser paperwork.

It's nice this IV Unit decided to give you more time to submit stuff on a joint-sponser.

You'll have similar stuff when you file AOS, but a tax year will have transpired, so in 2014 you'll have income for that job in 2013, a tax return proving it, plus the current annual income in 2014 - so I'm thinking you won't need a joint sponser when filing AOS later.
