Just lost job. Case is at NVC. Really Nervous.

Hi. My name is Dylan, I am 23. I have been spent two years in Mexico living in exile with my fiance. We were ecstatic the day when DOMA got repealed that I picked up my things and came to live with my mom to search for work. I finally got a job at Amazon.com, and filed the i-129f right away. I recently lost the job this week, and I just got off the phone with NVC, and my case just got there. I have a job interview today, but I am very well I am going to need a joint sponser. I used this site to file the i-129f, and I thank you for all your help. But I just really need to know what I need. Besides this year I haven't made enough to have to file taxes, and I am really stuck, and nervous because losing this job couldn't have come at a worse time. I am going to set the interview for late february, for Juarez. I just really would appreciate some advice because I am feeling so lost. Hopefully the interview goes well today.

Hi Dylan,

The i-129f is the right route.

Congratulations on the engagement.

I believe that you can use your mother's income (or that of another family member) as long as they make in excess of $ 20,000

Couple of things

i) WHATEVER YOU MADE, you HAVE to file taxes (fiance or no fiance) smile.png

I hope you have been filing taxes every year (even if you live abroad you can file taxes online - or do it now if you haven't)

ii) Regardless of whether or not your mother, another parent, a sibling or a cousin co-sponsors the immigrant - they have to have filed taxes as well

iii) CIS will combine the income from step (i) and step (ii) - as long as the AGGREGATE figure of your+your co-sponsor's IRS tax transcript EXCEEDS $ 20,000 - you should be ok.

If i'm not mistaken, only the previous year's tax return is needed - but its good to present for as many as and upto 3 previous years.

I would strongly suggest that you hire a lawyer. There are many exceptional ones in arizona.

Thank you for your response. I already have received my NOA-2, and my case is at the National Visa Center now. I have heard lawyers don't take cases this far along. I'm not worried at all about anything but the i-134. All of my family has been to Mexico, and have been close since the beginning so I have a lot of evidence. . I will start looking for a cosponser now. I will start researching the taxes thing, because I am clueless on that. But I will make sure I file this years taxes before I go to Juarez.

Dylan:

File taxes this year even if your income is low. You can file no matter what your income is.

The first thing I would try to do if I were you is to find another job fast. You will need one that pays 19,300 a year in order to ask as a sponsor. That isn't too hard to find if you are in Phoenix. If that doesn't work look into finding a joint sponsor. Just make sure the consulate you are using allows one.

I would still consider having a joint sponser. I am somewhat in the same situation as you. My fiancé left to go back to mexico and I ended up living in Mexico with him for 2 years. I returned last year and had only worked in December so I clearly didn't make enough. My fiancés interview is jan. 15th and I have't made enough this year working all year so my parents are so-sponsoring me. anyone who is an immediate family member is able to co-sponser. if you are living with your parents you may want to ask them

how can someone find out of a country accepts co sponsers or not? I thought they all did since it is on the application?

Is cuba one? I might need to get a co sponser if I do not find a job soon. I have made well over the poverty level this year and previous years however unemployement income will not count as income. haha but no in all seriousness I havent filed yet because I am looking for work. I knew I should have filed this past summer but then I would still be in the same boat if not more screwed.

A co-sponsor can be any US citizen or permanent resident with residence in the US. They do not have to be an immediate family member or live with you.

And yes, Juarez accepts co-sponsors.

The USC petitioner and the co=sponsor each fill out their own I-134 and provide supporting documentation, such as most recent tax transcript, letter from employer and/or recent pay stubs The co-sponsor should also provide proof of being a USC or LPR in case it is asked for.
