Hello folks,

I would like your input about my current predicament. I filled for my Wife (resides in India) and received NOA1 on 1/29/2013. The receiptnumber starts with MSC (I understand this is NBC now), however the has been transfered to Atlanta Field Office since March of 2013 (According Tier2 USCIS customer service rep). I have made three service requests (07/31/2013 request result: pending consideration, 09/16/2013 request result: pending adjudication, 12/09/2013 request result: pending consideration). USCIS is not answering why the file hasn't progressed any further, and I was advised to set up an Infopass appointment.

So, I have an appointment for 12/23/2013 at ATL field office for my case. I would like your observations about ATL field office, and if you are aware of their current situation. What should I expect from this appointment (I have a verry passimistic expection considering how much it has been dragged on for)? Are there certain questions I can ask to better understand a possible decision date? How is the general reception by interviewee, what more information can I provide to help them make their decision quicker? I am considering asking for expedited service, though I can't seem to find much resource online on how this is received by field offices.

have you looked at the USCIS guidelines for their requirements to have your case expedited? Those reasons with very compelling evidence is the only way your case would be expedited.

Atlanta is a very slow field office. They did not even start working on their Aug 2012 cases until close to March or April 2013. In your case, filing the I-129F for the K3 may be of benefit if only to get the I-130 out of the h#ll hole that is the Atlanta field office.

Isn't K-3 non-immigrant visa?

How does I130 / I129F work?

Once she gets here on K3, all we have to do is file for change of status? or Does she have to go back to India to complete visa process in India.

Also, How long is the processing time for K3 visas? Six months or so, How much longer will I 130 take, filled in 01/2013... Sure not more than 6 months... Any data about ATL processing times?

In your case, filing the I-129F for the K3 may be of benefit if only to get the I-130 out of the h#ll hole that is the Atlanta field office.

What do you mean by that? Will filling for I-129F push the file out of ATL into another office or just the regular I129F processing will be quicker than I130?

Atlanta is a h3ll hole, no doubt about it.

However, some things for you:

1. learn exactly which questions to ask and of whom, at the Atlanta Office. Don't settle with the first human behind the glass, that human, mostly is useless.

2. FIND the Atlanta Topic in the IR-1/CR-1 forum, then study all of the posts there. Atlanta has been lagged since 15 AUG 2012, so bear that in mind when you read those posts.

What do you mean by that? Will filling for I-129F push the file out of ATL into another office or just the regular I129F processing will be quicker than I130?

Well my wife is from the Philippines but I can honestly say I have been right where you are.

I am a Jan 22nd filer and I was told by a tier 2 on 2 different occasions that my file had been

transferred to Atlanta so I decided to make my 1st info pass and it was scheduled for Oct.10th.

I went and as you go in you will have to go through security just like at the airport also you will

need your passport or another form of ID. Be sure to take your info pass appointment sheet with

you because they will ask you for it at the check in desk scan it and give you a number. You will

be seated and wait for an immigration officer to call you up to the window.

When I went on Oct. 10th the officer called me up to the window and asked me how long had my case

been filed and I told him. He took my receipt number and told me since it had been so long since I filed

that he would pull my file and adjudicate my case and told me to have a seat. He called me up 20 minutes

later and told me he said we don't have your file it's no where to be found. He then told me to mail certain

things back in and as soon as he got it he would adjudicate my case. I waited 3 weeks and nothing happened

so I made another info pass appointment Nov.10th and talked to a different officer he took my receipt number

and I told him what had happened on my previous appointment. He went back to the file room and was gone

about 20 minutes and came back with my original file. My appointment was on a Friday and he said he would

come in the next morning and adjudicate my file I didn't really believe him because it was a Saturday morning

but he did what he said he would do because that saturday morning I received a call saying my wife's I-130

had been approved and received my NOA2 about a week later. I was approved on Nov.4th. Be sure to take

your NOA1 with you.

Awesome, Congrats bro!!

I intended to take all of my documents, and I will call USCIS tomorrow and record as much detail the tier 2 rep will provide me as an evidence if ATL decides to pull "don't have it here" card.

I've been reading the threads other's have mentioned just incase I have to dig in and make a stand, i wanna try to push back a little bit.

It' feels great to have some positive news.

So far, after having read through the posts that I felt were relevent.. I've compiles a short list of question... It would mean a lot to get all of yours response to it, and possible additional questions.

Infopass Questions:

Ask for I-130 Unit Supervisor. (If possible)

Which current month are they processing?

How are files selected, based on chronological order or randomly?

What is the status of my file? (Physical location of file, if possible)

ATL referral number for my inquiry on status update.

Has an adjudicator been assigned to my case? If so when?

If not, when is the earliest possible date?

Has FBI name check been submitted?

How many case files are ahead of mien as of yesterday?

Approximate date until decision? (It will be 329 days on 12/23/2013).

Ask for priority attention at NVC (Expedited case number and invoice ID)

How long will they take to send to NVC, and by which process?

How often/frequency are approved files sent off to NVC?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
